If I understand correctly; if I am able to travel to the US on my current valid K1 visa, can I than file for AOS the same as usual? Or does this EO block me from filing for AOS

Does not affect AOS, ROC, Naturalization.....

My fiance is in Austria too. But, she is waiting to receive her visa once the Consulate re-opens. I considered having her go to Canada, if possible, for 14 days and then have her enter the country as I have seen others get across the Canadian border with K-1s. I just need the Consulate to re-open first. Your plan is worth a try. Definitely let me know if it works.

Canada-US border is really hard to cross right now. Not sure if that will change by the time consulates reopen but they had to clamp down on land borders to "essential travel" because there was still so much traffic between them. Air borders seem a little better but Air Canada just cancelled all US flights until end of May and I wouldn't be surprised if others followed suit. Not to mention, entering through another country miiiiight raise a bit of a red flag to the CBP officer taking the visa, I dunno.

Does anyone know if consulates and for my case the American Institute in Taiwan will open May 4? We had gotten our interview date for K1 visa (approved) just need to get interview done. They cancelled our interview that was set March 15. What is most worrying is that we were given a 90 day window to have this done. This due date is May 15. I'm not seeing anywhere about the consulates opening but I assume they will because they are the arbitrator of some of the qualifications to enter under this EO suspension.  Any insight is appreciate.

There are still some US carriers operating transborder flights, but there's no way to tell how long those will last for. If I was in your position I'd personally try to travel before the 27th, but it also doesn't appear to be a last chance situation either.

Posting this again for visibility:

Who does this affect?

  • Immigrants applying for a green card from an embassy abroad for the following immigrant categories:
    • DV
    • All EB except EB-5 and EB2 (NIW only)
    • F1, F2A, F2B, F3, F4
    • Parents of US citizens (but not spouse/child)

What does this NOT affect?

  • Nonimmigrant visas of any kind (F-1, J-1, B, etc)
  • Nonimmigrant work visas (H, TN, etc)

Who does this NOT affect?

  • Anyone who's in the US at the date of the order, i.e. including existing Adjustment of Status applicants
  • Anyone who already has a valid immigrant visa
  • Anyone entering to work in healthcare/medical research, and their spouse/children
  • EB-5 and EB2 (NIW only)
  • Spouse and minor (under 21) child of USC

But really concerning that part of having a valid visa in the EO, just above it says the opposite.. like they’re included in the ban, can you please clarify? Thanks
