Update on the K-1 Process after speaking to the NVC today

So like a lot of you who are in a pre-interview mode, you are stuck right now with all the embassy's shut down, our interview will be in Bogota. We are supposed to have the interview by mid July and somehow I don't see that happening during this Covid-19 crisis. The NVC said they are holding all paperwork that they would normally be sending to the Embassy's for interviews. The nice thing is she did provide me with my Case # which they received from the USCIS on April 2nd. So she told me when we send your paperwork to the embassy you will get an e-mail notification. But my problem is with my paperwork being held the Bogota embassy doesn't know I exist.

 

So I asked how will the embassy know to extend my date for the interview when they don't have my paperwork? Is it automatic? and if it is, again how would I know the new date?. At the NVC website it only states "The I-129F petition is valid for four months from the date of approval by USCIS. A consular officer can extend the validity of the petition if it expires before visa processing is completed" So I assume its going to be up to me to contact the Embassy in Bogota at some point and ask for an extension.

 

Anyway if you have anything to add to this feel free or maybe you have already run into this before.

I'm in the same boat you are at the same consulate.  I was NOA2'd about six weeks before I was expecting it.   I'm not sure how this would work if, in a worst case scenario, the petition expires without ever being sent on to Bogota.  I'm operating on the assumption that I'll need an extension to get the interview done now.

You don’t have to contact your embassy since they are yet to receive your approved petition. But if you chose to, you will be told your file is not with them. It will be extended considering the fact it’s not your fault.

NVC is still shipping cases out to the embassies so, what she told you is either wrong across the board or true only for certain locations, one being Bogotá. In the PDF (link below) I discuss how you can check to see if your case was or is in transit to your embassy

 

NOA2's are extendable by the embassy in 4 month increments up to one year. If it expires, you'll need to start over. 

 

Many of your questions are valid but at this time there has been "no direction" put forth with regards to how USCIS, NVC or the embassy will handle their portion of the K-1 process. For you it will need to be more "wait and see".

 

Keep in touch with NVC for your case number and invoice number. If you get those than you can keep moving forward as there are documents and appointments that you may be able to complete now.

All I can tell you is I never told her what embassy I was going to and she said ALL embassy’s. I can only relay what I was told. But thanks for the great info!

@VisaDonnie Do you mean your status has been ' in transit'?

She can tell what embassy you are going to by your case number.

Im not even sure how you booked an interview without your case number or the embassy having your case on file.

No really in transit, my paperwork to go to the embassy in Bogota is being held at the NVC until the embassy opens.

I didn’t say I booked an interview, I’m saying that pretty soon I will have to contact somebody at the embassy to get my NOA2 date extended because I’m not trusting that they will do it automatically.
