I’m not understanding something here. If there is a problem with doing a prenup now, why won’t there be a problem with doing one later? If it is the i864 he is worried about, he needs to sponsor you with that regardless of its K1 AOS or a CR1 (spouse) visa. If it’s not the i864 then why does a different visa help? I also (1) don’t think you’d get a tourist visa (2) would he worried that if you did he would expect you stay illegally and not be married to him, which is all sorts of bad news for you. How else does he expect to resolve the prenup issue?
