I am a US citizen, pregnant, living in Argentina with my Argentine husband. My husband and I want to move to the US after the baby is born.

 

Can we start the IR-1 visa process before the baby is born? We want to move as soon as possible after the birth. Could the baby delay or complicate the IR-1 process?

You are married and can start the process anytime (now is best)  you have a long wait for the petition to even get to interview stage (about 12 to 14 months) so the baby will be here by then

u need to make sure you (USC) are filing US tax returns or have proof of why you do not need to do this (and a joint sponsor if that is the case)

the baby will not delay or complicate the process but make sure you file for his/her US citizenship and passport after the birth

 

check the above guidelines to know the process (or USCIS site) and know the income needed to support the family

If you are eligible to pass citizenship to the child at birth, you simply submit a CRBA application and upon approval the child receives a US passport

Or apply for and get the child’s US passport from the US embassy if CRBA eligible.

Simply being CRBA eligible doesn't get you a US passport.   You must have an approved DS2029 first, then comes the passport application

Thank you both soo much. I will pass citizenship onto the baby as soon as they are born.

 

I was worried that the pregnancy could complicated my husbands IR-1 process.

 

We are gonna get started right away!
