Hello,

 

My mother just got married with and  american, she is brazilian and i  am too.

I was being covered by her application for my visa, because I was under 21. But by accident her boyfriend called the bank and canceled the check he had sent to USCIS, they canceled my case and returned all documents. Now I am 21 years old and I cannot be part of my mother's wedding case to get the greencard.
What I wanted to know is if I can resend the same documents to the same case with a new check, and if there is a chance that they will accept.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You can’t send anything. You must be petitioned by am eligible USC

You will need to be a little .. well a lot ..clearer about the situation. It’s hard to fill in the blanks. What was your mother’s basis ? When was it filed? How were you connected to her application ? What is the status of her application. What country are you in ?

Sounds like a K-2 follow-to-join.  You have to be under 21 years old when the K-2 visa is issued.......you no longer qualify.

I was when i first send the documents ans the check. But her husband cancelled the check, about 2 months ago. But my case was going, i take the fingerprints, then they cancelled my case and send back my documents. Now my case status is "Petition/Application Was Rejected For Insufficient Funds", and i am 21. Thats my question, can i resend my documents now for the same case with a new check?

No.  You must be under 21 years old when the K-2 visa is issued..........it has not been issued, and you are 21 years old........the fact the process was started does not matter.  You no longer qualify for a K-2.  You now must be petitioned (I-130) by either your mother (after she becomes a legal resident) or step-father (under certain restrictions).

You are talking about your case and the fingerprints. What case? USCIS case or embassy? Where did you go for fingerprints? Are you already in the US under K2 and now seeking GC or you are still in brazil seeking K2?

I am in Florida. Her visa is K1 and my K2, we sent the documents to USCIS on November 28, 2019. The check was canceled in January 2020. My case was still being processed, I took the fingerprints, and then they canceled my case. Now his status is "Petition / Application Was Rejected For Insufficient Funds", they sent me the documents back and three notice of action, about travel authorization, work authorization and the greencard.
When the case started I was under 21, now I am 21. What I want to know is if I can resend the documents for the same case with a new check.
