I previously sent out forms 1040 and 6251 for 2018.

Payslips for last 3 months that show an income over 125% (yearly).

They asked us to send further supporting evidence and implied that income isn't sufficient,  I assume because without the 1099 and w2 it's irrelevant what the rest say.

I got 1099 and w2 for 2019 but no 1040 as taxes were not filed yet.

Should I send these and that's it? What should I write for total income?

You sent an incomplete tax return copy for 2018. The RFE is saying you need to send a complete tax return copy: 1040, all W-2s, 1099s, 2555, etc.

2019 taxes are not due yet due to the pandemic, so they cannot be required yet. But if you don't provide it now, have it ready if you get interviewed.

So should I only send 2018 W2 and 1099?

What should I fill in the total incone section of the i864?

If you have only filed for 2018, then yes - send them the 2018 tax documentation they requested. As noted 2019 is not required at this time as the filing deadline has been extended. Sending them another incomplete tax return copy (W-2s without a 1040) is likely to cause more confusion IMO.

Total income for an employee is what you make in a 12 month period. So $paycheck * #paychecks_per_year = $total_income.

Example: $1000/paycheck (gross) * 52 weeks/year = $52,000 total income.

Current Total Annual Income is what you're making right now (your current salary or hourly rate * hr/week *52), before any deductions.

People still get confused and use the Income on the return, which is not necessarily true. That's why I always suggest sending an employment letter/paystubs to prove current income.

There's the mini table where you write which taxes you attached. There's a total income section there. What should be written there? It's at part 6 24.a.

If you read the question, it says exactly what you need. Adjusted Gross Income. There's one line on the return/transcript that has exactly that.

Further questions:

Is tax exempt interest considered income or assets?

In 2018 there was no income but there was interest, is this considered income or not?

Also I see people mentioning line 22 has the income and line 37 has gross income. There's no line 37, it goes up to 36. Referring to 1040 schedule 1. And 22 is under "Additional income", right?

You were probably looking at older posts. In 2018 the 1040 was updated and total income was on line 6. For 2019 it's line 7b. Just look for the line that says "total income".

Looks like on 2018 "total income" is line 6 and "adjusted gross income" is line 7.

So "tax exempt interest" does not count as income? looks like the income for that year doesn't include it despite it showing up in the 1040.

If the current income is sufficient but the last tax return doesn't have sufficient income - will they accept or deny the form?
