Hey all,

 

My husband and I are compiling the last of the paperwork/info needed to submit his AOS. We just had our wedding a few weeks ago in accordance with the K-1 Fiance Visa, and are now nearly ready for the final submission.

Now for my question:

Given the situation of the world at the moment, I just heard/read today about the new order postponing Green Card/AOS permanent residency requests for the near future. I understand this is due to job opportunities being available for American Citizens first. With that being said, does this impact my husband in terms of next steps? 

I am assuming we send in the submission as normal, and should we expect a delay on the reply? We are comfortable and willing to wait however long is necessary given the circumstances. I am simply hoping that this does not put him in a situation of illegal status, or require him worst case to leave.

Regardless of the EO, you should submit the Adjustment of Status package as normal.  Once the I-485 is filed, he will be granted authorized stay in the country while the form is being adjudicated.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
