Section 3 states that the CO (nothing to do with USCIS) will determine eligibility for an exception. DHS (almost certainly just CBP specifically here) will work with DOS to enforce compliance (i.e. so improperly issued visas and such can still be a basis for denial of entry, just generally so CBP knows the rules around visas during this period).

I would just reiterate that these are not guidelines. These are orders. The COs are determining if one meets the requirements for an exception. It does not grant them the ability to expand or restrict those exceptions.

 

Anyway, the question was asked about parents of a USC (IR-5 category). There is nothing in the EO that could be construed as an exception to that category.

It's possible a lawsuit may be filed resulting in an injection to grant such an exception - based upon the equities of the situation and low likelihood of taking jobs - or to provide a means for a waiver. But that is not a CO's decision to make. It's simply not a "well maybe some will and some won't because of a bias."

Haven't read everything in this thread yet but just wanted to share if it helps anyone's mind be put at ease that I was able to enter the United States on April 24th, no problem whatsoever, Immigration officer didn't mention anything; no warning. He just asked for my packet and stamped my passport and visa and sent me on my merry way. My fiance and I are finally together and now just looking for a way to secure a marriage license. I didn’t see my husband since 2 years now , iam waiting processing  for my interview , u can imagine iam eagar to be a mother. How can it come now . Really iam depressed, i know its hard to all pepole around the world also to my husband who  live alone with fear now. I understand the order is good for the pepole in USA now , it’s really good decision but care about family members. U know iam living alone also with fear . Really i want to be with my husband specially that days.

My husband just went into processing after his interview and the wait time for that is 60 days. Have you waited that long? We are almost 2 years now. So I know how you feel. It is not right to keep a married couple apart more so because of our stand that America is "in God we trust" and has been since the founding of it.

It’s same happened to me .! It’s been 2 years I haven’t meet my husband😭😭He is overseas..! He is also waiting for his interview..! We have no idea how long does it take ..?😭😭60 days ban for immigrants..! But I am looking forward now..I can’t believe it’s only for 60 days ..! It can be extend more than 60 days..! I want to see my husband..! 😭😭God please help me..!

You can expedite it to interview but with the embassy s all on hold I don't know about that now. But in April someone expedited and then before interview they sent a email to ask for an emergency appointment due to covid-19 and then they got their interview and visa right away. I asked what they said in the email but I got no answer yet.
