My boyfriend is a medical student and he plans on coming this summer for clinical rotations to earn credits for his degree. Is Trump’s latest ban on immigration going to prevent B1/B2 visas as well? Or is it just for those who are coming to live and work? He’s from a European country that was not part of the 30 day travel ban. We are kind of freaking out about this now.

no one knows 100% but the aim seems to be at keeping jobs for USCs.

Answer unknown at present.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

If K-1 is not excluded, there is going to be a tidal wave of CR-1 applications heading towards a process which already takes longer than the fiance option as many will look to secure their marriage even off-shore in case anything like this happens again.

I can definitely see that happening. But in the short-term, meeting up to spend time together anywhere in the world is challenging.

CITIZENSHIP TIMELINE

2/2020: Interview (10 months)

But he isn’t coming to work. He’s coming for a program for which he will not be paid. That’s why I’m confused if this will prevent him from coming or not.

yes, my answer wasnt to ignore your question but to illustrate the point of this executive order, no one can answer how expansive it will be as no details have been officially released. It seems as a student he should be ok to enter, but again the breadth of the new EO isnt finalized.

Okay, thank you for your response! This whole thing is so ridiculous. Banning legal immigration is cruel.

So if you are on a L1 and already working in the US, you already have a role that is not going to stop a USC getting a role as it is not an open position.

The EB1-C seems to say you are very much a needed part and / or an executive of the organization you are working for.

Why would USCIS stop that employment AOS? What would be the benefit to an unemployed USC?

The new policy would deny entry for people seeking most types of work visas for at least 90 days, according to a draft order obtained by Bloomberg News. Technology industry workers living in the U.S. on H-1B visas, however, would need to provide updated certifications to the government that they are not displacing American workers. Refugees and asylum seekers would not be affected by the order, nor would spouses and children of U.S. citizens or permanent residents.

Second hand information I received says that AOS (marriage and employment based) should not be affected by the EO.

I wonder if our Seattle backlog for marriage-based AOS interviews will clear a bit if the EO is geared toward the H1Bs.  We waited for over a year for my husband's interview, which was January 30 of this year (thank god!).

Btw, I saw a post from a K-1 visa holder from BC who stated that she was turned away at Peace Arch crossing when trying to enter with her K-1, last weekish.  Pretty surprising.

Oh wow. That is pretty surprising. I wonder if that might be because fiancés are not considered immediate relatives of USCs yet? Who knows.

Here’s hoping that the backlog starts to clear a bit. That would be a silver lining. I’m surprised they don’t send more of the AOS petitions to the Yakima or Tukwila offices to lessen the workload in Seattle. Honestly I’d have been happy to make the drive down to either just to speed this lengthy process up, and I’m sure I’m not alone. Being in limbo for so long waiting for a green card is exhausting.

Tough job but someone's gotta do it. Especially on a topic such as this which is inherently political. And it's hard to discuss a yet-to-be-issued executive order. :)

Most people here just want to know if there's an exception in the EO for their particular case. But the EO hasn't been issued, only rumors, guesses and innuendos.

When it is eventually released, I'm sure the non-political aspects of the EO will be dissected. For now, you have your work cut out for you getting rid of any political comments.
