They need 2/3 majority to pass any legislation that the president couldn't veto. Under the current senate climate, this will never happen. Besides, they are already too preoccupied with stimulus bail-out legislation to deal with this. This is precisely why Trump and his administration has decided to jump at this particular time of unrest and mass fear (they figure not too many Americans will care too deeply about blocking Immigrants -- and they only need to spin it that they preventing such people from bringing in COVID-19 into the country).

Timeline

Waking up to this news and my heart is crushed. It's very hard to adapt the 'just be patient' outlook that people are recommending, when there are more factors than just longing to see your partner at stake.

 

I have a valid K1 which was issued and I was supposed to travel from the UK on the 8th Apr, but couldnt due to the travel bans. My visa expires on the 9th Jun.

Meantime, I resigned from my job in Feb and gave my 1 month notice, so had just finished working when this all hit. I also work in the travel industry and there is zero chance of getting my or another industry related job in the present circumstances. My US fiance has therefore paid the downfall between my rent/bills that my savings couldnt cover for the last month and would have continued to do so until the travel ban was lifted. Now I am going to be stuck. I have no family here in the UK as I'm originally from Australia, which before anyone comments that I should just go back there, I have 2 pets that were also coming to the US until their flight was also cancelled and are not allowed to go to Australia for a long time.

 

I had just made peace with the fact that my visa might expire before I can travel and would have to go down the route of a possible reissue request based on information from the UK USA embassy, so even after all the months worrying about the initial K1 and process, I had accepted it was just going to take a bit longer. Now, this announcement may be forcing us to be apart for an indefinite period of time. My US truck driving fiance who hasnt stopped working through all of this to ensure food and essentials are still delivered throughout the US, who is paying double rent and then some, for us over there and here due to the crisis is so upset, as I am.

 

I am completely lost,  my heart is so deflated.

yeah, no. I have no authority or reach to even start a letter. This is only the upper circle nor do I have any knowledge about suing the government and if this even allowed by the constitution or not. Executive orders must be backed up by the constitution. Those are facts. Checks and balances. No government, city,state,federal, has full power. Research and knowledge is good .

Yes, I was wondering the same thing. How would that help save jobs if hundereds or thousands of USCIS and NVC workers would be laid off?

 

Also I can't see how this would be legally enforcable to have hundred thousands (or even millions) of US citizens separated from their wifes and children... Doesn't seem like somthing that could be rationalised with protecting US jobs.

Stimulus (finance) and immigrations are two very different departments.

No one is going to stop the EO because no one wants to be held responsible, by any party, for more COVID-19 deaths. Technically the courts can challenge the EO, and maybe they will, but the national emergency makes that very unlikely. It's possible, however, that this ban won't outlast the pandemic as the economic grounds alone are hardly sufficient justification for keeping it. (Legally the President can ban any alien from entering based on health concerns - that's in INA.)

12/27/2016 USCIS suddenly reforms the entire NIW criteria system, replacing a 20 years old one. Uncharted waters. 
01/07/2017 (Saturday!) EAD/AP renewal package with new forms received in Phoenix "reception desk"
01/17/2017 EAD/AP renewal case accepted; text/email with receipt numbers was received
01/30/2017 Law firm finally confirms that USCIS has suspended processing all EB2-NIW cases due to new criteria. 
02/23/2017 USCIS slowly starts adjudicating NIW cases again.
04/21/2017 Extended EAD/AP received in mail. Valid for 2 years. 
05/06/2017 Received a massive RFE on I-140 NIW case.
07/20/2017 RFE response received by USCIS (a very long response with 30 pages of docs)

Has anyone been approved for their CR-1/IR-1 and hasn't set foot on US soil yet? I'm thinking of just taking the next flight out of the UK. My husband and I have been waiting so long in the first place due to other delays. I'm thinking of getting the next flight at the weekend.

Makes little sense to stop the processing for people who are already here, if they have the virus they don't get less contagious by having their immigration processes paused.

Exactly this, if its backed by constitution, nothing will help to block it, EO will be temperory and all will be fine eventually. :) We know politicians will try to sue government on this to show that they are doing it for you but we all know they will be doing it for themselves bcoz election is coming.
