That is already in place, few countries already banned americans from entering their country. Every country is trying to protect their citizens.

This is simply scapegoating but I’m afraid he could sign that as soon as they draft the order and whatever legal issues will be debated on thereafter and it’s gonna be one messy slow process. Absolutely childish move but not surprising from this administration.

This is correct. Under his new elevated "powers" because of the pandemic, he can sign EO into action (supposed to be as soon as today, Tuesday, 21) and it will not be challenged.

Correct, EOs do not.

I have no idea why, but the comment you quoted used to be on another thread. It looks like it got merged into this thread, but the original post did not. Note the timing - early morning yesterday. This EO was announced only hours ago.

The issue raised in that thread was about a report of opinions to modify immigration law and restrict fiance or spousal visas, alongside other types of visas. It was not about an EO to suspend immigration.

It probably couldn't be challenged anyways. We've had 20+ years of massive expansion of the powers of the Executive, enthusiastically endorsed by both sides of the aisle.

Because the one thing both parties agree on is having enormous unchallenged executive power is really awesome when your party is in the White House.

It's like they genuinely believe the other party will never win again or something.

“Congress has the power to overturn an executive order by passing legislation that invalidates it. ... In the case of the former, the president retains the power to veto such a decision; however, the Congress may override a veto with a two-thirds majority to end an executive order.”

 

That being said, I do believe this order will be carried out, especially with the current emergency in the U.S.

Though currently it’s near imposible for anyone without a passport to get one. I’m stuck in that particular mess as well - they have my citizenship certificate and no idea as to when I will actually get the passport. Some who paid for expedited service (while that was still an option) have been waiting 8 weeks.

3/2020: Oath & naturalization (11 months)

6/2020: Passport received (3 months)

Officially a U.S. Citizen!

That being said, I do believe this order will be carried out, especially with the current emergency in the U.S.

Title 42 of the U.S. Code enables the president to halt immigration for health reasons, while a 2018 U.S. Supreme Court decision upholding his travel ban gives him legal precedent

Is the Europe travel ban already lifted? It was supposed to be 3/12/2029 for 30 days till 4/12/2020. My parents have IR-5 visa in passport but are not in US yet. Are they considered permanent residents yet or not yet as they have not cleared port of entry officer yet, they do not have physical green cards yet. If travel ban is lifted, could they still fly in from Germany now?

No, they have to enter to be LPR
