Timeline

Hi 

 

This might have been asked before but now due to the whole corona virus and delays. When it is finally safe to travel again, would me and my 2 children be able to travel to the US for the summer to be with my fiancé out there even though our paperwork is pending?

Actually no, not without a tourist visa unless your country/USA requires only ESTS for you to travel to the US. With you and the children traveling together and a K-1 Visa pending (I'm only assuming that's the visa you are applying for as your profile is not complete) you might be turned away from boarder patrol. They may view that you are staying beyond your allowable time and not return to your country and go forward with the visa. I'll let others chime in as this is not really my area of expertise. 

 

BTW 

We need a little housekeeping on your end. Many of our answers are predicated on the information you supply in your profile. When we look at the left column and can't determine your timeline OR your Embassy it's hard for us to give you a factual answer. Our answers will sometimes be tailored to a specific Embassy hence the reason for you to complete your profile. We all currently have Estas as we have been to the US within the last year.

Welcome to VJ. Glad you joined. Thanks for completing your profile. It makes it easier for us to respond to your questions as each country and embassy can handle things differently. 

 

Then you may be able to travel but you still are under the ruling made by boarder patrol once you arrive to your first POE. The concern is "will you return to the UK at the end of your visit" which will be the question in the BP's mindset.

Yuck ok, my anxiety is far too great to be dealing with 2 children and the potential of being turned away at the border. 

 

We were just thinking because I ser Trump is putting a suspension on immigration 😰😱 that perhaps we could spend time there before the kids end up going back to school

You can. My husband visited me in the US twice on his B2 visa before the K1 paperwork was finalized. He wasn't asked anything about it either time. A lot of other VJ users have reported the same (we had heavily looked into this before making the decision for him to travel). 

 

Edited to say that if you are looking at coming sometime very soon, there is a ban on UK citizens entering the US at the moment. Otherwise, it''s fine.

It was becoming an option. I mean we put our paperwork in back in November so we are waiting patiently and hopefully will have answers by the summer. Just the thought of being turned away with 2 young children fills me with absolute dread. I think he is now going to come here, take extra work leave and spend a month with us in Europe

You will need to wait until the travel ban is lifted initially and for you to travel now from the UK- it must be deemed as essential travel. 

 

It's easier to travel from Ireland- Dublin as you can go through pre-clearance immigration so you don't have the risk at being turned away when you land in the US as checks will be completed in Dublin instead. I'd be hesitant in booking anything whilst this pandemic is going on.

 

For general advice on travelling to the US with ESTA is ensuring that you will not over stay. You can show ongoing commitment to the UK by proof of job, lease etc
