Tax return shows single because the system demand my spouse social security and will not allow NRA either is ok to submit it like that or do amends people advice I am at nvc level

If you are married, you cannot file as single.  If your spouse does not have and SSN or ITIN, you will have to file married filing separately.

Yes, you cannot efile married filing separately, you need to do your return on paper and mail it in.  If you were to file as single when you are actually married, it can come back to bite you both from a tax standpoint and an immigration standpoint.

Sack the tax guy. The “ system “

requires you file married.. mfs your only option

Your tax guy is incorrect.   You must hand write "NRA" in the spouse SSN box, then mail the return to the IRS.  You can not electronically file.......

If at this time you are amending to send your return transcript to NVC, you can send the transcript to NVC as is and do the amendment later on. I would expect amendment process taking several months especially this time.

NVC will not reject it, filing as single or married is an IRS issue.

I was in your situation. First, thing NVC will accept as single status and as someone said it is IRS problem. Second, you should file as MFJ and mail to IRS. Since, you are at NVC stage better you do MFS. Since, MFJ would be hard to do and required lot of paperworks.

I had done filing as MFJ and can help you with it.

The tax liability between MFS and single is the same.  No reason to amend as it will not change your tax liability which is what is the most important thing to consider

That is not 100% correct.  There are certain credits, ie. the earned income tax credit (EITC), American opportunity credit, Lifelong Earning Credit, that you are not eligible for if you file MFS, but are eligible for if you file Single.  So, if you file Single and receive  the EITC, or these other credits, and the IRS later determines that you received these credits when you were not allowed, you will have to pay back the credits, and you may be banned from receiving the credits for some years in the future.  This is why you should be filing using your correct filing status, it makes a difference.
