Since she signed the petition already, just file as soon as soon as possible with the required paperwork. The only way to get an extension letter is to file. You should get the 18-month extension in less than a month after you file.

If you were to lose your job now before the GC expire, just know that you can file for unemployment insurance.

I hope that everything works out for you.

I appreciate your help , since i can get the extension letter in 4 weeks from the filling date, i am happy with that and i will keep praying if our miraculous God can do his wonder to bring her to life, this is a woman i love and she care for me , she alway have me at her heart but i cant do anything to save the situation but to pray to God

If you presented a physical, unexpired green card for your employer's I-9 when you started the job, then they shouldn't be asking for any proof of extension from you and shouldn't be laying you off. This applies even to 2-year conditional green cards. The only time they're supposed to re-verify permanent residents is if you use something besides an unexpired green card such as an I-551 stamp in your foreign passport or an expired green card + extension letter. Has your employer told you that you'll lose your job if you don't prove you've extended it?

Employers should not reverify:
  • Lawful permanent residents who presented a Form I-551, Permanent Resident or Alien Registration Receipt card for Section 2. This includes conditional residents.

So sorry to hear about your wife. Now just file what you have. You can send the certificate later if need be since getting the extension letter is important for your job why wait. It's not like the death certificates speeds up anything.
Soon as you file extension letter will come in 2 to 3 weeks. They are still processing applications.

Before there are any more snarky comments about the OP's worrying about debts or ROC while his wife is on her deathbed, please put yourself in his position. I am sure it is difficult for him even to figure out which way is up right now, and he is doing the best he can in an incredibly difficult situation. If I became ill and my husband came her asking for help, I would hope he would not receive the same treatment. Also, for those of you who have been fortunate enough never to have experienced similar difficulties, you would be amazed the kinds of mundane details your mind fixates on in the midst of unbearable trauma.

OP, I am sorry for what you and your wife are going through. I hope you have received the advice you are looking for (which is to file your ROC now and update as needed later).

As somebody actually going through something very similar, I would be devastated if my SO felt like I was leaving such a burden on them by my passing.

I'm hoping (and assuming) there is a language barrier or something as the wording actually used is quite disheartening.

Edit: Just reiterating that I am assuming it is a wording issue.

U get me wrong , i am not upset , i appreciate your help but i told u the family knew she has gone home, she was a fighter, she work hard for me , she told me what to do if she cant make it,cancer is terrible disease, hospital be calling everytime for decision but i rest everything on her family, as i told them whatever they agreed on is what i agreed on, if i can get extension letter in 4 weeks i am not bother but i am just been stress out for bills of over 3000 dollar in a month, if u know what i am going through right u will alway pray for me than saying i want her dead in order to file some papers

I actually think I understand what you are saying completely. Your wife helped you get the paperwork together to Remove Conditions (that you could send off now) but you want to know the best course of action since her family is unwilling to take her off life support.
So a couple of questions....do you have a copy of all the supporting documents and paperwork ready file? If so...why not file now. Your wife is still alive at this point and you can amend the paperwork later (unfortunately, something that may happen to a few people removing conditions.....due to the pandemic).

And why the rush? It is my understanding that you must file before your conditional green card expires but that is three months away. Why not support your wife and her family and apply after her unfortunate passing?

I’m sorry.....what do you find “snarky” about any of the comments..... I actually found them fairly “tame” compared to his original post.

Apparently, the OP’s wife had a plan to help him get his 10 year green card (she completed the paperwork) and now he’s biting at the bit trying to figure out what to do.

In addition, We should ALL have a plan for what happens if one, the other, both, or all, become ill. Especially on this journey.....
I’m sorry.....is that “snark”?  Unfortunately I can be “snarky” without knowing it.

I am supporting her but she is not doing well at the moment, everytime the hospital keep say we are sorry , it is getting worst but my 90 days window is already open but was just asking to know the lenght of time to get extension letter if i should wait as my 90 days is now running or just to wait a little before dropping the application off, i am just seeking for an opinion but was told by vj members to submit the already signed application then if anything contrary happen i can update it later

My 90 days window  to file for a conditional removal is already open as from 17th april and right and my greencard expired on 17th july and my job badge expire the same july 17th and if i dont have an extension letter  i am going to be  layoff-,right now my wife who is my spouse signed the papers before she feel critically ill and right now she is passing away as the doctors said she cant make it as her kidneys are failing due to the cancer, she is now breathing on ventilator and the doctors advice that we should take the decision to take off the ventilator for her to pass away but her family said No. I just want to hold on to get the death certificate because the hospital make a conference call with us and the family and told she is dead but still breathing with just the ventilator,i wanted to wait for her final breath before going for the death certificate and file as widow but right now i am stuck wirh this decision  to wait or submit the file she already signed as my 90 days are already open and the timing to get extension letter,i feel sad as she left so much burden on me

Why cant you show your drivers license and SSN card to meet the I9 requirments for your job? To legally work, you do not need to show your physical green card. If you show your green card, they will make your work badge expire with the green card expiry date. If you show your driver license + SSN, your badge will have an expire date of your driver license.
