So it says "based on the information you provided, your priority date could not be established."

 

She entered on a K-1 and we were married within the 90 days. I provided the NOA2 I-797 Approval for the K-1 as instructed in the how-to on this site. They sent it back too, so they saw it. It's asking for an original I-130 or copy of I-797 for the I-130, or "other evidence that an immigration visa petition has been filed on your behalf."

 

Any ideas? I didn't think I needed to do the I-130 if we were already doing the I-129F process. That's all the info they gave me.

Right. Priority dates don't apply to fiance visas. Glad you found the mistake. Are you going to re-apply or send back a new I-485 with this rejection notice as a response?

Probably just send it back with a new I-485 after re-checking everything much more slowly this time. I have the 2 copies of everything as recommended though, so either way is pretty simple. They didn't take my payment yet, and so they said nothing has been "filed" at all yet, so it probably doesn't make much difference. Pretty dumb mistake on my part. I can't believe I did that.

Well, for one thing, it's good they catch these kinds of things early on at the Lockbox level. Imagine if you had waited until the service center finally got to your petition months from now and then found the mistake.

Someone, probably a low bid contractor firm, now gets to type the form into a computer and since there isn't a match to an I-130 it gets kicked out.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

At the first stage, they look at forms filled out, payment, signatures. They don't look at evidence. So if the AOS form says there should be an I-130 petition, and there's nothing about that in the package/system, then the package is rejected. If there wasn't this first step, the money would be cashed, and the petition would be denied later on by an officer, which is worse.
