He has a Chronic Obstructive Pulmonary disease at his age he anything can happen. So if that happens then what kind of a son am I? I am working enjoying the US benifits while my dad is suffering in the death bed and now he is dead and I choose not to take care of him? dont make sense for a human behavior point of view

OP, what has changed now? Have you found a suitable caregiver to take your place when you return to the U.S.?
 

U.S. immigration will likely see you abandoned residency by choice (difficult though it may have been) rather than by necessity.

The problem is that your want you cake and eat it.

 

If you permanently reside somewhere, moving to another country and taking a job is somewhat inconsistent.

 

I do not know how your aquired your LPR status or for that matter how long you lived in the US before moving back to the PI, it does appear you have done nothing to maintain the US as your permanent residence.

 

Also begs the question how you acquired it is the first place and whether that option is still open. What is the plan, do ypou want to move back to the US permanenently or just fo enough to keep residency?

Well the father option is not quick, so your father is a USC but returned to PI and you followed him? Any reason you do not naturalise?

Well you could have naturalized a long time ago.  Now thats out of the winodw and you will probably need to find another way back.

 

Most likely your son can sponsor you when he turns 21

The bottom-line of this whole issue is this; , the opportunity to come to the US is basically gone. I know it's hard to hear, but then better know the truth. Immigration doesn't care about traditions in your country, all they care about is whether you followed or did not follow instructions. Unfortunately, the situation is that simple.

Thank you to those who gave their comments about the situation at hand. Well, at least I heard the truth and be able to construct my decision. I know I've asked lawyers before but of course I want to know other people perspective.  Hopefully all the opinions if not majority are based through experience and not just personal conclusion. In any rate it help me to decide if its worth to try or not, but the looks of things based on the opinions Ive been reading are all negative. I am ok with it, it is what it is. It is not the end of the world. I can still go to other places. The purpose of this forum is to see the 360 angle of this situation. Thank you for your opinions

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
