HELLO, I want ask about affidavit of support. I have few questions on how to do the I-864.

 

1. As of now, I am unemployed because of corona virus since March 20, 2020. If it will affect my current income ?

2. My husband and I, we filed jointly at the Income Tax Return. Where I could find my individual current income?

3. I am filing for both parents, but our annual household income is only 36000? Is it sufficient? Can I use our real state asset instead?

1. Depending on your employment status and income closer to the interview time , you may need to get a joint sponsor 


2. your payslips will be evidence of current income 

 

3. each petition stands alone. For each I 864 you need 125% (minimum...250% is better ) of the poverty line for your household plus 1 immigrant. You can combine your income with your husbands by using the .I 864a as well as the I 864   Be aware of the “public charge” assessment which will be looking at the likelihood of your parents becoming a public charge.

Your current income is what you make right now. if unemployed, presumably this is $0. If you obtain employment again, this would change.

Your individual current income is how much you make right now.

Generally pay stubs and/or an employment letter are sufficient evidence of this.

 

Where it asks for your income as stated on the 3 most recent tax returns, this is a copy/paste from the tax return. It doesn't matter if it's combined with a spouse or individual.

 

Generally, an I-864A from your spouse will be presented to join their income with yours. This would be listed as income from household members on your I-864, and they would provide an I-864A.

Minimum requirements for consideration: https://www.uscis.gov/i-864p

That said, the reality is the bare minimums likely won't cut it for parents, especially if they are of retirement age or have already retired. Healthcare costs alone are likely to be near or in the 4 digit range per month unless they obtain their own employer-provided insurance.

 

Real estate can be used, although be sure to follow the instructions in terms of evidence to provide for assets. If it's your primary home, it may (probably) be considered to cause undue hardship to sell it.

1) These can be included as they are income. Evidence of them would be current statements.

The applicability of UC is another issue. It is income, although how the IO weighs it given it is limited in duration is factor.

Item Numbers 1. - 4. Assets

To use your own assets, you must complete Part 7., Item Numbers 1. - 4. and submit corresponding evidence with this affidavit. Supporting evidence must be attached to establish location, ownership, date of acquisition, and value of any real estate holding

So you need to show:

1) Location

2) Ownership (mortgage is still fine)

3) Date acquired

4) Current net cash value ("Enter the net cash value of real-estate holdings. (Net value means current assessed value minus mortgage debt.)"). This means showing current amount owed and current value of the property. The latter may or may not mean an appraisal...I have seen people provide estimates from some websites, but generally they were qualifying with their income and listing the real estate in addition to that just for the IO's consideration.
