NOA 1 recieved 8 ½ months ago, and never asked to attend a biometrics appointment

Like the title says, we filed our I-130 on July of 2019, and got our NOA1 on July 11, 2019. Neither the lawyer or myself have gotten a notice of biometrics appointment, nor have we gotten a NOA 2. The lawyer filed an expedite request today, and I just got an email response that our case isn't eligible as they're waiting on our biometrics to be taken. 

 

When are they normally taken? Who's biometrics are taken, me or me and my wife? Why did USCIS not tell us that they wanted them before? Now we need to wait an extra month + because the finger printing locations are closed because of COVID-19?

Your timeline says you are applying for a spousal visa CR IR1 using the consular process ( foreign spouse is overseas). If this is correct then there is no biometrics appt for that. Processing of her I 130 can take 10-15 months. Once the I130 is approved (NOA2) then the application is sent to the NVC for document collation and processing , then to the overseas consulate for the interview and decision. Biometrics of the beneficiary ( foreign spouse) are done at the consular interview and again at the POE when the spouse enters the US using the spousal visa.

That's what I thought,  and yes, we're waiting for a CR1 visa for my wife who is currently in the Republic of Georgia. As for the USCIS email I got about 45 minutes ago, maybe you can see if I'm missing something...

It’s a standard response to an expedite request ... but it doesnt apply to your situation. 
On what grounds did the lawyer request an expedite ?? There are very few reasons for an expedite of an I130 to be accepted. 

Is the I130 at the Nebraska service centre ? If yes , then current processing time estimates from the USCIS is 12.5 to 16 months .. currently working on Dec 2018.... you’re getting closer but still have 6+ months to go at least 😓 before you’ll get your NOA2

She almost died during her first birth because of complications, now she's 3 months pregnant and per the Dr, most likely will face the same issues. Filed for humanitarian and financial reasons. 

 

Going off of the VJ timelines, over half of the NSC I-130s filed within +/-5 days of ours have been approved past the NOA 2 point.

I’ve looked at the USCIS processing times site .. vjers are a small cross section of applicants.  Talk to the lawyer as soon as you can.  though I’m sceptical of that achieving anything much .. unfortunately pregnancy isn’t usually given much weight for expedite ... she would have to travel in the next 3 months .. and as no interviews are being conducted at the moment .. and air travel bans in place .. I wouldn’t count on getting through the process.. and having her be able to enter the US before she enters her 6th month .. plan B ?? you go to her ?

Cant go to her as the borders are shut, and if in leave my job for too long, we'd have an issue with the 864. I can try to go in mid to late september should the borders open

Yes that’s your best opportunity. The COVID 19 event has dramatically changed things we had really thought would always be there .. need to travel ? Book a flight and go .. not now unfortunately .  I hope things go well for you all

Consular processing starts with the I 130 application. The petitioner.... you .. don’t get biometrics done at all... the beneficiary .. her.. gets biometrics done at the consulate interview and again at the point of entry. Biometrics as referred to in that email do not ever apply to the process that you and your wife are following.

If that reply was correct then it is very very very rare to take the biometrics from the petitioner for an I-130.  Maybe there is a reason that they might want yours.

 

It is also pretty rare that it takes 8 and a half months to get a NOA1 and while having an attorney.  So what is really going on here?  Did you review that the I-130 was correct?

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

We got the NOA 1 a few days after filing
