My status on submitted documents state. " Documentary qualified"  over the NVC website,  however there is a separate note  asking to submit petitioner's former marriage termination certificate.  

 

My question is should I submit those additional documents or just bring those with me to the interview?

What I'm afraid of if I submit those  is it going restart my review cycle? which already took about 4 months to complete

Did you submit that certficate before? If not you have to submit it, there is no way around. Additional submission won't take long to review.

Yes it was submitted to USCIS.  Now with NVC. this was never  required as required civil documents are for the applicant. Also they have approved everything and status is Documentary qualified so am not sure if I even submit it at this point.

Petitioner’s previous divorce certification is now a requirement by NVC. It does not matter whether you already submitted at USCIS stage. If you submit at NVC now  then you will go back to the line for review. It will take about 8 weeks plus  for review same as who just submit documents recently.  I would recommend you to call NVC to ask so that you know how to proceed.

Thanks for your advice. I did call NVC and according to them. if the case is documentarily qualified then you don't have to submit anything . They recommended just bring it along at the time of the interview.

Do you have to re-submit stuff like this that you submitted with the I-130 application?

This doesn't seem to make sense.  If you submitted something like this during USCIS and USCIS transfers your file to the NVC and it takes like 6 weeks to get it all input at the NVC, what happened to these documents that were already submitted?

Which one is not making sense?  

 

The time of reviewing the new document or the divorce document? If you said time of reviewing is not making sense then you can find multiple threads in NVC section in VI forum to see how long it will take to review the addition documents ( I am also waiting to them to review addition document since 3/6). If you said the divorce document is required at NVC does not make sense, then you can go on NVC website to see the requirement. They required me to submit again at NVC and they pointed me to the requirement on NVC document.

The submitting the divorce document again at the NVC stage.  Did you submit it with your I-864?  Or, did it go with with the beneficiaries civil documents?  

Note:  Maybe I mis-understood your circumstances.  Are you the petitioner or the beneficiary?

I am petitioner. I submitted to USCIS but not to NVC as many people said that you dont need to submit again. NVC sent me message that they required me to upload divorce to CEAC. I called them and they told me that it is requirement and also listed on NVC website. I uploaded document on 3/6 and still have to wait few more weeks for them to review.

 

 Here is word by word from NVC website for requirement “If you are applying for an IR1, CR1, or F2A visa as the spouse of a U.S. citizen or Lawful Permanent Resident and your petitioning spouse was previously married:  You must obtain evidence of the termination of EVERY prior marriage your petitioning spouse has had. This evidence must be an original or certified copy of one of the following documents:  FINAL legal divorce decree, death certificate, or annulment papers.”

NVC’s job is not to go through and find documents from your tens or hundreds of pages that USCIS forwarded. It will simply register and forward the entire package to the embassy once applicable. In the mean time it collects CIVIL documents as a part of their process. Marriage or divorce certificates fall under their CIVIL documents.

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US
