1-751 pending has 18 months extension letter but plans to file for divorce

i have a problem .My I-751 is pending.And me and my K2 was in 18 month extension.The problem is my husband has been a (removed) to me hes making our life miserable.His family his mom doesn’t like me too so the thing is we have a new place his name was in the lease too.Only to find out he doesn’t wanna stay here with us but he comes or he visits frequently because we’re just five minutes away from his moms house. Were 50/50 in all expenses.So in short it’s like we’re physically separated.I endured all that pain because were  still married and we have kids but Recently it really gets hard when I realize that he and his mom file for tax without me and claim my 2 children without me knowing.Good thing I found it so I also filed my taxes on my own nothing else I can’t take it anymore I’ve been disrespected and  for me it’s  not normal anymore.I feel  abused,so the thing is what if our 1-751 extensikn request for rfe about joint tax rreturn and bank joint account.We dont have any of that as he doesnt want to.I’m thinking of filing divorce because I cannot  take it anymore.From all the powertrip.I’m sick to my stomach I cannot take it anymore but I’m also scared that it will affect my status and we get denied me and my daughter. And also if I dont file divorce now ,what if theres rfe we dont have file tax jointly anymore because he filed married filing separately withount me informed. and we dont have joint bank account bacause he doesnt want too.He cancels everything.I know  he will jeopardize for not showing the interview.I really wanna file divorce now but I dont know if its the smart option or should i wait for uscis rfe or schedule for interview or if get lucky should i just wait for my 10 year gc.Please advise.Any advise would be much appreciated.

I would say be strong, just document everything... It's fraud if they claimed your kids on tax

I wanted to share my experience with you. I got divorced during my removal of conditions. I also had my extension and was waiting for an interview or my 10 year green card. 

 

I submitted my removal of condition on Sep 2016 by June 2017 I filed for divorce, because my ex cheated on me (among many other problems we had). My divorce was finalized in September 2017 and as soon as I had the decree, I sent it to USCIS and included other evidence that I had proving that our marriage was real, After a few weeks I called to make sure they got my divorce decree and they sent me a letter saying that they got my documents and they were added to my file. I was approved for my 10 year green card on February 2018, no interview no RFE.

 

If you want to file for divorce do it, get as many documentation of everything as you can, and notify USCIS of your dissolution of marriage. Keeping them informed is super important.

1.)When you got your final divorce decree,Did you  not changed to Divorce waiver form and pay again to Uscis? 

Or you  just send them letter just to add on the files on your ROC with the evidence.

 

2.)Did you really state that your ex apouse cheated like the extensity of your relationship?Cause mine is more of abuse and powertrip and bullying and not cheating.And also we have kids.It doesnt matter right?as long as tou have the final decree that will send to them

If you file for divorce, Write a letter to USCIS stating that you would like to change you i 751 to waiver, if you dont tell them and they approve your 10 yrs green card, you will be in trouble for misrepresnting on your app. Good luck.

1) no i didn't pay again, on the letter I sent along with my divorce decree I asked them to change my application to divorce waiver. The letter did not go into details much.

 

Like I said they approved me without interview. When I did my citizenship interview they did ask me why I got divorced, a simple "my ex cheated on me" was enough for the immigration officer.  I was ready to explain more if needed, especially because I divorced in the middle of removal of conditions, but no other questions were asked. So make sure you ask them to change your application to waiver, and follow up by calling and speaking to an immigration officer to make sure your documents were added to your file. 

 

She asked me if I had any kids but we never had kids (my ex didn't wanted to). I was also remarried at the time of interview, and pregnant, ( i though that would be a reason for questioning) but she congratulated me on the baby. It was a good experience. I am now a citizen.
