HI TO ALL ,

i have an important question i want you please to clarify it for me :

-If the offcier at the day of the interview says that one doesn't meet the income requirments, what 'd happen to our case?

Will it be sent back to NVC or remains at the consualte until finiacial stuf is regulated as having a co-sponsor OR what??

Your profile says you filed for an IR1/CR1 visa. In that case you'll have to fill out the I-864 (affidavit of support) and send it to the NVC during the process. More information about the I-864 here:

6/04/2009 - check cashed (fast!)

6/08/2009 - received I-797C (receipt date 6/01)

6/22/2009 - received Biometrics Appt. Notice

7/01/2009 - received rescheduled Appt. Notice

7/23/2009 - Biometr. Appt.

7/24/2009 - A touch, a touch!

8/20/2009 - APPROVED! Oh, glorious day!

8/25/2009 - Card production e-mail received

8/31/2009 - Card received. Error :(

9/05/2009 - Returned green card with evidence of error & I-90

9/16/2009 - received I-797C (receipt date 9/14)

10/27/2009 - Correct card issued

You either meet the requirements to sponsor your spouse or you don't. If you don't, you'll need a joint sponsor. Don't send in an I-864 without a joint sponsor if you don't qualify on your own. A visa will not be granted unless sufficient sponsorship is shown.

What I was trying to say was that if you are indeed filing for an IR1/CR1 your case will not even get to the consulate if you don't meet the requirements. You will have to prove your 'financial stuff' beforehand. So, your question can't happen.

That is correct. NVC will determine whether your I-864(s) are adequate. If not, your case doesn't go to a Consulate until the requirements are met with a joint sponsor or is rejected for failure to meet the requirements. There isn't a way around these requirements but there are several ways to meet them.

What I was trying to say was that if you are indeed filing for an IR1/CR1 your case will not even get to the consulate if you don't meet the requirements. You will have to prove your 'financial stuff' beforehand. So, your question can't happen.

No, the NVC will not evaluate the I-864. The NVC will check that the necessary information and supporting documentation has been provided, but it is the consular officer who will evaluate the information to determine whether or not the requirements for sponsorship have been met.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

During this process you submit your I-864 to the NVC level and they only scan over it . It then goes to the embassy with all the other paperwork and the consular will determine if you need a co sponsor. In my case this happened and before they would give us an interview I had to have my brother co sponsor my husband. In most cases they give you a short time frame to meet the requirements and if you do not they will send the file back to the USA as abandoned. Depending on the consulate they can tell you before the interview or give you a 221(g) after the interview and they will tell you how much time you have to comply with their demands.

A checklist.

- Income from employment - is an employer's letter included? pay statements? other appropriate documentation?

- Income from investments or other sources - is supporting documentation included?

- Assets - if assets are shown, is supporting documentation included?

- Past tax returns - at least 1 is required, is it included?

- etc.
