Police Certificate from home country if whole life in UAE

Hello,

 

I am a US citizen getting ready to submit a K-1 visa application for my fiancee in UAE. They were born in a different country moved her before turning 1 and have lived their whole life in UAE, only go back visit their family for a few months every couple years. I know they will need a police clearance from UAE but is it required to get one from the other country as well? Is there anyway to waive that requirement seeing as they've not been there as an adult?

Are 16 years old or older	Lived in your country of nationality for more than 6 months at any time in your life	Your country of nationality
Are 16 years old or older	Have lived in your country of current residence (if different from nationality) for more than 6 months	Your country of current residence
Have ever lived in another country for 12 months or more	Were 16 years or older at the time you lived there	The country where you used to live.

Note: Present and former residents of the United States do NOT need to submit any U.S. police certificates.

Important: Police certificates expire after one year, unless the certificate was issued from your country of previous residence and you have not returned there since the police certificate was issued. If at the time of your interview the following three items are all true, you must bring a new police certificate to your visa interview:

• You are more than 16 years old;
• The police certificate submitted to NVC was obtained more than one year ago; and
• You still live in the country that issued the certificate.

It's dumb because she wasn't over the age of 16 after living there IMHO.

If by visiting "a few months" that ever added up to 6 months or more,  get the police certificate.  If not, no police certificate is needed.  Details matter.

If the country in question happens to be Pakistan, the PCC is not required.

K-1 applications do not require PC's but will be required at the interview. If she hasn't in one calendar year (since age 16) spent more than 6 months cumulatively then she will not need a PC from that country.

Really? During the NVC process they won't ask for the Police Certificates? My understanding was that you cant complete the DS form without police certificates? She last visited when she was 18 for I believe 3-4 months. But never for longer than 6 months in a calendar year. Do you have a source for this because the links submitted above said 6 months at any time in life.

nevermind i found the source, thank you so much. You were right! Does USCIS ask you what countries you've lived in for over 6 months or do they leave it up to the individual to self report?

You'll be asked at the interview. Failing to provide this information can deem you inadmissible as you have committed fraud. Some forms may ask specifically your travel but off hand I am not a student of these forms so I would have to let someone else chime in.

no worries, thank you! My impression was that there had to be some kind of proof you have to bring of where you're living and for how long. And that the police certificate was needed before scheduling an interview. Getting a UAE Police certificate before the interview is no issue at all! She's only been out of UAE for 2 weeks since she turned 16 so definitely doesn't need any other police clearence.
