I would agree that it was an oversight. This thing was rushed out the door (not that a rush wasn't needed...) and it has flaws.

I think the goal was to prevent certain normally-NRAs from qualifying for it, but the mechanism they did so hits some edge cases (in-process immigrants) as well.

 

The good news is it's only a timing issue. Presumably they will qualify for the benefit on the 2020 taxes. And if not by the time of taxes being due, amending taxes to do so later would still be on the table.

Not optimal, but it's not like the money is lost either...just delayed.

Interesting point... Ultimately perhaps filing a 1040X once my spouse moves Stateside and has an SSN.

It was the same with the 2008 stimulus. Millions of illegals have ITINs. There are other benefits ITIN filers do not qualify for as well.

Yup, it was. But the USC/LPR spouse has no legitimate reason I can think of not to qualify even in that circumstance.

Probably since IRS does not check immigration status it was more efficient to skip a few in a big advance rollout. Immigrant spouses still have the opportunity with 2020 return.

Make sense.. i filed my taxes on first week of feb and since i owed Irs i didnt provide my bank info.. but in 2018 tax return, they should have pulled up my bank info as i received a refund. Anyways i entered my bank info this wednesday and nothing happened yet

Just thought I'd ask this here on this thread, as I'm wondering if there are others in the same situation in regards to amending tax returns. My wife and I (US Citizen) filed our 2019 joint tax return early Feb, was accepted by IRS but as of now is still processing. For 2018 I initially filed married filing separately, then when my foreign spouse received her SSN we amended our 2018 tax return to Married Filing Jointly. We got confirmation it was completed and we received our refund from that amendment last month, but on my IRS tax account it still says I filed 2018 as married filing separately. I'm hoping this will be updated soon because I'm worried they will go by this info for the stimulus payment. BTW, we like many people are getting the "Payment Status Not Available" on IRS get my payment portal.
