You could have gotten an SSN with your K-1 visa within the first 76 days (90 days status - 14 days left of status required).

How did your wife file her 2019 taxes: Single? MFS? MFJ? HOH?

If she filed as Single (incorrect), MFS, or HOH, then that explains why only she got one.

That would also explain why you won't get an advance rebate - if she did any of the above, you would not be a resident alien for tax purposes in 2019, so you don't qualify.

When you file 2020 taxes - and use an SSN - you can claim the any part of the tax credit you are missing. So assuming you file MFJ in 2020, you would qualify for $2400 (+/- any adjustments) - $1200 she received.

You can't.   You will possibly have to wait and get a tax credit when you file 2020 taxes.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

My apologies. A couple of corrections I have to make here.
My (American) wife received her covid-19 relief check based on her 2018 tax filings. Which she filed as single.
We have yet to file 2019 taxes (because we first have to receive info back from the Canadian government that needs to be included in our US 2019 tax filings). Which we will file jointly.
I do not yet have a green card because my green card interview was postponed due to covid-19 office closures. I do however have a US "employment authorization" card, which, as stated on the card, "serves as i-152 advance parole" and allows me to work in the US while I wait for my green card. This "employment authorization" card does not include a SSN but does include my nine-digit USCIS number.


So, I think what has to happen is, we have to file our 2019 taxes (jointly) and then I will be able to apply for our other half (my half) of covid-19 relief money. I think. But I'm not sure. As I expect I still will not have a real SSN number.

Thanks for any additional insight anyone can provide.

Gotcha.

So yes, the advance rebate was based on the 2018 return since there was no 2019 return yet.

When you file 2020 taxes (jointly, I'm assuming), you can claim the full $2400 (assuming joint income is under $150k) at that time, and deduct the $1200 received.

 

What happens with the 2019 return now doesn't really matter. The advance rebate already went out in your case. Yes, file it...jointly is probably best financially....but it won't impact the advance rebate. You'll get the rest with 2020 taxes.

 

I'm assuming you are self employed? While an EAD lets you work, an SSN (or ITIN) is still needed for payroll purposes.

You can get an SSN with a valid EAD. Just stop by the SSA (once they reopen) and apply.

I don't think so.........I think you will have to wait and get a $1200 tax credit next year when you file your 2020 taxes.

Same here no payment yet. Probably we will get it on a second batch. Are you able to see your payment date on IrS website ?

Did your spouse file a 2019 tax return Married Filing Separately?
If you had filed a joint return with your spouse for 2019 and submitted the statement choosing to be treated as a resident alien for tax purposes, then you could have been eligible based on filing a tax return.  In my opinion, filing a 2019 return by yourself now won’t work because for 2019 you can not pass either the greencard test or the physical presence test to file as a resident.  You may be eligible for the stimulus on the 2020 return filed next year if your income (joint or separate filing) falls below the threshold for eligibility.

I filled my taxes  in my home country since I was there more than 6 months, my spouse earned less than 15k so nothing I could have saved her tbh. Thank you for the help..
