Hello!

I have some questions about the Pandemic Unemployment. I had 2 part time jobs, one aloud me to work remotely with less hours  and I'm currently doing that but my other job was a cashier in a supermarket that didn't follow any rule to protect their workers or the clientes againt the COVID. And last weeks of my job were intense and hard that led me to having panic attacks so I had to quit for my health concerns. I only worked in that market since December of last year so I think maybe I could qualify for PAU, but I have a condicional residence and I heard that asking for un employment benefits could be an issue when I ask for permanent residence and citizenship. Does anyone knows wha is the best to do in this case? I live in NY btw.

Thank you!!

Stop listening to those people.   Unemployment is NOT a federal benefit.   Apply and let the state determine your eligibility

Similar question-- my husband is also on a conditional green card but quit his job at a grocery store because he had asthma in childhood and the supermarket wasn't doing a good job with protecting its workers. I told him just to quit so our family can be safe. We are also unsure if he should try to file for unemployment, or if this could be an issue for ROC later.

Similiar question gets the same answer.  FILE!!!!!  FILE for your benefit and let the state determine your eligibility.

Make sure he has documentation. Many states are still going to consider this voluntary loss of work, which normally leaves someone ineligible to collect unemployment. Laws vary by state, and I am not sure if there have been any changes during the pandemic, but generally he would have to show he had a valid reason for needing to quit, such as the health issue, and also that he was unable to resolve it with the employer before quitting.
