Both i-751 AND n-400 in limbo

Hi everyone,

 

We applied for my husband's N-400 in August 2019. He had his interview early March 2020. Everything went well but because there was no update on the I-751 we had applied for him back in July 2018, they couldn't give him an answer and said it would take up to 120 days for a decision to be made. Well the extension on his current green card just expired a few days ago which means he cannot work or apply for a new license. We  called USCIS and they said someone would call to schedule an appointment at the nearest service center  so he could get an extension on his green card (first time I'm hopeful in a long time!!). Someone called back later that day and we explained that it's been a long time for the green card and that because we're moving, my husband needs to be able to apply for a new license and be able to work. Instead, he just would NOT shut up with useless information about how we legally need to change our address when we move and wouldn't stop talking for even a second to allow us to ask a question. In the end he finally said he cannot schedule an appointment because the offices are closed. Seriously, what was the whole point of having someone call us and give us false hope like that? 

 

We had put in an enquiry request earlier on the I-751 and we just got it back. "We researched the status of your case and found that your file was received by the Washington Field Office on 03/03/2020.  Your application is currently pending review by an Immigration Services Officer.  You should receive further information regarding your case.  If you do not hear from the Washington Field Office, you may contact our National Customer Service Center using the information listed below."

 

I also noticed that this morning his n-400 application status now says:

Estimated case completion time

June 2020 (2 months)

 

 

For a while this was empty (I'm guessing because of the covid-19 closings?) and before that it had previously said April 2020. Does anyone know if this changes based on something actually happening in the backend or is this some automatic thing?

 

Wondering if anyone else is in the same boat as us.

Yeah, this Covid19 situation has turned a lot of things on its end including immigration proceedings.  I am sure there are others in your situation, but unfortunately, the only thing you can do is wait for offices to reopen so your husband can get an I551 stamp.  Did your husband have an interview at the AOS stage, or did he come here on a CR1?  I know there are some cases of AOS being approved now without interviews, I have not heard of any ROCs in that discussion, but who knows, but I do not want to give you false hope.

It's anyone's guess what USCIS does that triggers updates. I would take comfort in the fact that you have not received an RFE or other requests. The timing of your case could not have been any worse coinciding with the world-ending recent events. It's too early to seek assistance from congresspersons in your area and in the corona era, may not even work so well. If expired card and lack of stamp on passport becomes a hardship (need to start working, can't access some benefits, etc.) you may need to contact USCIS in writing to express extreme economic hardship. Or just wait out the two months if possible. Hopefully you will hear something soon.

If he isn't changing his current job, I would wait until the closure is over. It's too complicated to get it done right now as it's related to your husband's I751. You can always request to speak to a tier II officer and request an urgent infopass appointment and see if they are willing to accommodate. The regular representatives on the phone are a pain to deal with.

2020-07-16 I-751 & N400 approved. Sworn in as a US citizen.

2020-07-16 Registered to vote & applied for passport
