When Corona ruins your plans

Hello everybody,

 

I am super happy I found this forum! 

 

So a little background info about my situation:

I'm European and I was due to fly to the US this month to marry my fiancee, then fly back to Europe and get a lawyer to help us with filing the I-130 form. 

Well as you all know Corona came around and I had to cancel my flight and cancel the wedding altogether. On the good side, during this lock-down I had plenty of time on my hands and I decided to 

research more about how to file the I-130 form and I actually think a lawyer isn't needed. I believe we can save money and file the petition ourselves. My soon-to-be husband isn't very good with filling in forms,

so basically I will be me assisting him and - with a little of help from this forum - I can think we can be successful. As soon as the travel ban for the EU is lifted (I really hope before the summer), I will fly to the US to get married.

 

Meanwhile I have made a list with the documents that we need to assemble the I-130 package. Please let me  know if I forgot something:

  • Cover letter
  • Money order $535
  • Form G-1145
  • Form I-130
  • Form I-130A
  • Petitioner's certification of naturalisation
  • Copy of beneficiary's passport
  • Two passport style photos of the petitioner and beneficiary
  • Copy of the marriage certificate (which hopefully I have by August 2020)
  • Copy of divorce decree beneficiary (I was married before)
  • Letter explaining how we met
  • Two affidavits of support from friends
  • Photos of us (we actually don't have many photos with friends)
  • Screenshots of video calls 
  • Ongoing WhatsApp text messages
  • Passport stamps
  • Hotel reservations with our names
  • Western Union receipts 

 

Can someone please comment to let me know I'm on the right track?  Thanks a bunch  🙂

NOA-1 Issued Dec 21, 2015 NOA-1 for ROC issued

NOA-1 Issued Dec 26, 2015 NOA-1 Received

You dont need the copy of beneficiary passport unless youre trying to show entry stamps for visits.  Nor do you need a letter explaining how you met.

Yes I saw that my passport isn't actually needed, but for some reason I feel silly not to add it (I know I don't make sense lol, why add something that isn't required?). I just think it will humanise me a bit more when they review the petition, since I don't live in the country of my nationality nor in the country of my birth. Just for them to get a clearer picture of us and our love-story. Also we really don't have many photos together or with our friends, not sure if that poses a problem? I do have tons of screenshots of our video calls and chat logs.

*** The OP has received sufficient advice, however, a word of caution is needed. Sometimes, in an effort to help, some advice is not the proper way of doing things. Planning to fly to the US to adjust status to circumvent normal immigration processes is visa fraud.
