In 2018 I filed single, and in 2019 I filed joint tax return with my wife who is in the AOS process but doesn't have a green card. She does have a SSN and on the tax return I said she was a resident alien. I'm going to wait for the new tool to check refund checks but do you believe she may qualify for the 1200$?

 

It would appear she didn't qualify for advance payment but will be eligible for credit on 2020 return

Hmm. I shouldn't had waited until last minute, but that will be awesome for her (for us really) to eventually receive 1200$ since she is also affected by COVID-19 though I understand a citizen first approach. I'm honestly surprised to see immigrants with a SSN qualifying for stimulus checks.

  It wasn't a citizen first approach. Your 2019 return was just too late to be used for the advanced tax credit calculation. You got your $1200 based on your 2018 return. Your spouse will be able to get $1200 as a credit for 2020.

Not quite. You can file jointly with an ITIN and there wont be an advance credit check.  Not an issue for the OP though!

Correct. Although an ITIN is not really specific to immigration status. There are current LPRs with only an ITIN because they haven't received an SSN yet.

So it's related, but not the determining factor.

Neither of them get the advance payment (Edit: unless the military exception applies).

When they file 2020 taxes, if they use an SSN for both individuals, then they will qualify for the full credit.

 

It does appear to be an oversight to me, but that's what happens when people are rushed.

I am a USC with SSN and my wife is still in limbo in Canada awaiting interview. I filed MFJ and used her ITIN and reported her Canadian income for 2019 taxes and yesterday I got a direct deposit for $2400. I saw earlier yesterday where the same happened to someone else but can't find the post at the moment. So either they're screwing up (which is very possible) or they've changed/waived the ITIN thing. Guess we'll see what happens with everyone else.

Anyone who wants to see if he/she is eligible can now use the official IRS stimulus payment portal (which just opened today).  It will tell you if you are eligible, and it will allow you to update your bank information.  https://www.irs.gov/coronavirus/economic-impact-payments .  I just used it to provide my bank info to the IRS.  It also said "You are eligible for this payment".

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

ONE OF THE 80 MILLION!

Just got our payment this morning...deposited directly to our account...the full $2,400...based on our 2018 filing (have not filed 2019, yet).

Nice to have.

Why this for the profile pic?  Often in movies and on TV when they show Hawaii they show this beach/view. So, instead of doing Kauai or some other locale, we decided to do here, so that whenever some show shows Hawaii and this view, we will see where we were married.

Received ours today based on 2019 filing.  My wife received her GC in February 2020, but we filed MFJ in February and she was considered a resident alien for tax purposes and therefore received a payment in full

Hello!

If a couple has not filed jointly yet, but the stimulus check already came for the US citizen in the couple, the non-citizen spouse has no way of getting the stimulus separately this year.

Is this correct?
