My wife and I will be divorcing. She is probably 2 months away from the interview to get her 10 year green card. Does anyone know what will happen when she shows up without me. Our marriage was legitimate, she is unable to have children and this was a surprise to both of us. We have spent over a year and a great deal of money on infertility to no success. She deserves to stay in the US without question. Having children was my main purspose in going to Ukraine. I will probably want to go overseas again as soon as possible. I do not want to take any action that will hurt her obtaining a 10 year card, but also do not want to do anything to prejudice my being able to bring in a new lady, possibly late this year. Any feedback before I talk to an immigration attorney would be great (I have done all the paperwork myself up to now).

Wow...you are something else. Maybe you should make sure the next lady is fertile. :blink:

To answer your question, as long as there is proof that this marriage was legitimate (i.e. bills, mortgage/lease, insurance, letters from friends, etc as proof) then I'm guessing there won't be a problem. I would definitely talk with an Immigration Attorney. I doubt seriously you'll be bringing in a "new lady" late this year as its already mid June. Just a thought.

05/03/2007 I have an unofficial "PETITION APPROVED" ...waiting for confirmation from Consulate

Wow okay we are in June which only leaves six months in the year. I am guessing your divorce will take up most of that time. Obvious IMO your wifes infertility has nothing to do with this, you already have someone lined up!

2005 - We met

2006 - Filed I-129F

2007 - K-1 issued, moved to US, completed AOS (a busy year, immigration-wise)

2009 - Conditions lifted

2010 - Will be naturalising. Buh-bye, USCIS! smile.png

if she get Divorce within 90days of filling removal of condition of green card(10yrs).she may probably have to deport from US.

she should have to get divorce to claim for abused spouce before 90 days.

Still confirm from attonrny....

If Love is there ,you should think about Adoption of child.it will better.Just advice still dicision is yours .after all it is your life.

04/09/07 - I-130 and I-129F approval email sent!!!!

04/26/07 - Packet 3 received

06/26/07 - Packet 3 SUBMITTED FINALLY!!!!

07/07/07 - Received pkt 4

07/22/07 - interview consular never bothered to show up for work.

07/29/07 - interview.

I am certain your comment/opinion won't change but it has only been about two years.... (applying for the 10 year green card)
