So i just recently received my SSN + EAD Card and me and wife have filled a joint tax return where at the same time i applied for an ITIN number, for tax purposes i guess i'm classified as a resident Alien, am i eligible for the $2400 (filled jointly married couples) stimulus cheque or just my wife for $1200?

If i am not mistaken,  if you filed using an itin, you are ineligible for the advance payment

Yup, ITIN is not considered a valid identification number, unless as the spouse of an active member of the military in the tax year for which they most recently filed (2018/2019). So no advance rebate.

But if you file 2020 taxes with an SSN, you will be able to claim the full credit at that time.

If an ITIN was used on the 1040, they will not eligible for the advance rebate. She (and you) can still be eligible for the underlying tax credit on the 2020 tax return. So you'll get the full amount, just not early.

I'm not sure what an SSN resident is.

You are not a non-filer. You filed jointly.

Ha oh damn, looks like i filled at the wrong time as i was catching up on her 2018 & 2019 taxes and we applied for an ITIN when i didnt know my SSN was on the way.

 

So we cant use this in 2021 when we do our 2020 taxes?

The stimulus early payment is based strictly on the tax return you filed (2019). Having a SSN now does not put it on the return already filed, nor can it be. A joint return where one party has an ITIN means no early payment for anybody on that return. Had you not filed 2019 yet, your wife could have gotten her $1200 based on her 2018 return if you and the ITIN were not on it.

The stimulus will be on the 2020 return and you both can receive it then as long as you are under the income threshold for tax year Jan-Dec 2020. 

 

The IRS application thing is for non-filers. You filed, so that’s not for you. It’s for people who had such a low income that they didn’t meet the income level required to file in 2018, 2019 and likely 2020. It’s a way for them to get their name on the stimulus list without having a return on file.

When you file your 2020 taxes, you will both use your SSNs. You will be able to claim the credit ($1200 per adult, assuming income is under the thresholds where it is reduced or eliminated) at that time. It will directly increase your refund (or lower your taxes owed if you owe) by that amount.

As noted in the thread previously, how taxes were filed in 2019/2018 will determine the advance rebate eligibility. Tax credit eligibility will be determined when filing taxes for the 2020 tax year.

Piggybacking on this to ask another question! I entered the US on a K1 in September 2019. Got a SSN right away without the work authorization, then we married in November 2019. My EAD arrived in March 2020 and I got my SSN updated then with the DHS work approval. My question is - if I had an SSN in 2019 with no work authorization, do I still get factored in to the benefit? Because I wasn't working we qualify for more as a joint household income. We actually haven't filed our 2019 taxes yet, taking advantage of that deadline extension.  Not sure if that hurts anything either.

Your work authorization (or lack of it) is not relevant to eligibility here. All that matters are how the 2019 (or 2018 in your case since 2019 is not filed yet) taxes were filed.

In your case, the most recent tax return was from 2018 and that would filed as Single I'm assuming. If so, the advance rebate will be based on $1200 + [qualifying dependents] - [$5 per $100 over $75,000].

 

The tax credit you will get on your 2020 taxes will be based on your 2020 return. If filed jointly and with SSNs for both people, then you will qualify for $2400 instead of $1200, with a $150,000 reduction threshold.

Any amount already received is deducted - so if you get $1200 in advance rebate, but qualify for $2400 on the 2020 taxes, you'll get an extra $1200 refund at that time (or $1200 deduction in tax owed if you owe over $1200).

 

tldr: You'll get the $2400, but only $1200 in advance.

I received a direct deposit of $2400 yesterday. Filed 2019 taxes MFJ with my Canadian spouse with an ITIN. She's still in Canada awaiting interview. Could be a mistake?
