So all that stuff on the CBP & embassy websites about the i94 not being extended after visiting neighboring territories is just nonsense?

 

Rather curious he claims to have done it for 5 years while also claiming to be a US citizen, but whatever. Would suggest his MIL packs all her things to take with on this short trip as she may find she has an unexpected long holiday in Canada, Mexico or wherever while waiting for flights home to open up.

We all know despite USCIS not recommending that everything is dependent on the immigration officer decision at the time of re-entry.

 

The fact they were able to do it for 5 or 10 years does not mean it will always work but there's also no reason to be sour about others people decision. We should be here to support each other and if we don't have anything nice to say better just keep scrolling.

I guess some people think fair warning of what could happen given what the law says is “being sour”. How does encouraging someone to do something likely to have negative immigration consequences count as “supporting each other”? In my mind, “supporting each other” means encouraging each other to follow immigration law so as not to risk losing status, losing a visa, jeopardizing future visits by the mother in law, etc. (and in fact you yourself did the right thing under the circumstances).“supporting each other” is not the same as “telling people what they want to hear” or “being nice”. If you don’t like the fact that immigration law isn’t always what you want to hear, keep scrolling.

Now whether you could do it today is another thing, his visa came up for renewal and he knew there was no way he could get another with that travel history.

The wording from this link suggests to me that USCIS will be liberal with approving extensions.

 

If "unexpected stays" implies something extreme like hospitalization, it doesn't follow that they'd state most nonimmigrants can mitigate the situation by applying timely for an extension.

 

Open to hearing other people's opinions and interpretations.

Generally, nonimmigrants must depart the United States before their authorized period of admission expires. However, we recognize that nonimmigrants may unexpectedly remain in the United States beyond their authorized period of stay due to COVID-19. Should this occur, the following options are available for nonimmigrants: 

Apply for an Extension.  Most nonimmigrants can mitigate the immigration consequences of COVID-19 by timely filing an application for extension of stay (EOS) or change in status (COS). U.S. Citizenship and Immigration Services continues to accept and process applications and petitions, and many of our forms are available for online filing.

I don't see him asking for your opinion to start with, he was just stating what he have done before... so better keep your opinion out of this thread and yes telling someone to pack a bigger bag it is uncalled for.

I agree, it sounds to me like it will be pretty easy to get approval under current circumstances. I’m guessing the exceptions to the “most” will be people already on an extension or similar.

Why is USCIS an enemy?

(Okay...I'm not really expecting an answer as that would go off topic. But USCIS is just following the laws and rules in place today.)

How funny is this:

logged into USCIS account today to see if any I-551 updates were posted there... card production still pending.

Howeeverrrrr, there was a notice posted for the I-539 dated 11 Oct stating a biometrics appt was scheduled for 3 Nov. WE NEVER RECEIVED THE NOTICE--not that it mattered anyhow.
