CRBA 5 year residency requirement

Hello guys,

 

I am a USC (naturalized), petitioned for my wife via CR1 which is pending. I am hoping her visa is done around November time. My wife is British, currently in England, and is pregnant (due in August). I was reading up requirements for CRBA, and it seems like I have to provide proof of 5 years of residency. My question is, does it have to be broken down month by month, and how would I show proof of some months where I wasn't working/going to school?

I'm currently a medical student so I have transcripts for 2 years (10 month academic year x2), transcripts for my bachelor's degree and post bacc work (12 semesters so about 6 years), I can also get employment verification for the years I worked, but that was during my bachelor's degree, which overlaps with my school transcripts. 

These are not continuous, back to back - I took a gap year after bachelor's to apply and get into med school. I also took a gap from working during this time to take the MCAT and all that jazz.

 

How does the documentation really work?

First, the required time is not residency -- it is physical presence.  It is all of the time your body was in the US in any capacity (a tourist, a student, a worker, a resident -- legal or not).  It does not have to be a continuous/consecutive five years.  If all of the schooling you mentioned was in the US, you should be good to go.

 

There is a form (DS-2029) you fill out to apply for the CRBA where you list all the dates you were in the US.

Further to this topic, may I ask if the 5-year period should be counted after the citizen parent becomes a citizen or obtains his/her green card? Thank you!

It would be any period of time spent in the US, regardless of status. This has been my understanding.
