Visa b2 denied 2 years ago. Can I go to the US for AuPair?

J-1 visas are subject to INA 214(b). You can be denied due to lack of ties to return home.

I agree that this is viewed differently than that of a tourist visa given the timeframes involved, but they certainly won't issue a J-1 to somebody that they think will stay longer than the timeframe permitted.

Given the case history here, I can only assume it would be a negative factor. But only way to know for sure is to apply.

 

I will just add that to an outsider, it does look like a directed effort on coming to the US specifically. Denial on the VWP is unusual...they had something that raised suspicion already. Then B visas denied. There was a USC fiance/fiancee as of at least a little over a year ago (you were looking at the I-129F closer to 1 year than 2 years ago).

Timeline

Given the time that has passed and obviously this is a future query I would expect this not to be an issue, now if you are looking to be an Au Pair in the same area as the ex boyfriend, or other more complicating issues I reserve my right to change my opinion.

That’s very odd. I visited my husband more than 40 times on the VWP before moving here. It was never even suggested that I might be visiting too much and my ESTA was never revoked. Seems odd yours would be revoked after 3 visits over a 3-year period. I sometimes only had 4 weeks between visits.

Au Pairs

Only exchange visitors placed through a Department of State-designated au pair sponsor are authorized to work as an au pair. Au pairs provide child care to a host family’s children for a year in return for room and board, a weekly stipend and up to $500 in education costs.

Because the host family provides remuneration in exchange for regular child care services, the host family is the au pair’s employer and must complete Form I-9 for the Au pair.

Of course.  J-1 is a NIV.

 

The burden is on you to prove you do not have immigrant intent.
