Which is why I said although it might be asked/ checked it is unlikely that the embassy will be looking at the ds-5540 for a K1 at the moment, but the I-944 will be required at AOS.

Keeping with the OP's topic

In regards to the K-1 and the embassy; the K-1 is a non-immigrant visa those forms would not apply at the embassy, which is also why the I-864 isn't used either.

The K-1 visa allows a "90 day visit", if the person marries the petitioner the beneficiary is then allowed to adjust status, and that is when "immigrant" comes into play.

Yeah but this has always been the case. But people on FB and in certain Filipino Immigration groups on there are blowing this up as if it's something new

I feel sorry for people that don't find VJ. Some of those FB groups are a mess.  We had a different word for it in the military but it is not family friendly))

Finally done...

Oh goodness there was one on there which the page owner ended up getting a RFE because he didn't bring his tax paperwork to the interview for his family. Which is pretty self explanatory and he should know this if he is the page owner and someone actually selling his "services" to people for USEM. @John & Rose were talking to him about this, the guy ends up getting mad then blocking us from his page.

Then on the Visa Approved page it is so full of misinformation and other BS posts from some of the members promoting videos, MLMs. The page is written out in English and there is nothing on there saying it's predominantly for Filipinos but even if you write post in English then people respond back to you in Filipino even after saying "English Only". I wrote a post talking about this and asking the Mods if they could just put a short blurb on there about the page being for Filipinos, and I got a lot of push back from them on it.

Your income needs to meet or exceed the 125% poverty guidelines of the I-864P,  for two people that is $21,550.   Embassy only requests the most recent tax return and a completed I-134.     It is that simple

Hey there, I'm about to send in the taxes for income on line 31 of 21,804. And pay about 4k in owed taxes etc.  I want to make sure that they go with the number on line 31 ? on the Schedule C? Only this?    Because the AGI is only 19,711

I hope I got it right! thanks

with line 31 'net profit'

2nd question is that my financee has a 1 year old baby who lives with her mother and father in province. They will take care of the child for a year or 2 in Php.  This means I still claim 2 dependents for household and income min is still at 125% poverty of 22k is this frowned upon ?  or is the 28k a better number? or am I thinking too much?

Everyone skipped over this part. Is the baby yours? I am no expert but as far as I know, you will need to get a CRBA, a SSN for the child, and also the child must reside with you in order to claim as a dependent. I have 2 children which I am the father who are still in the Philippines with the mother while waiting to complete immigration and I have not been able to claim either of them yet.

To claim your fiance, soon to be wife, she will need her SSN as well or an ITIN.

No the baby is not mine. I'm simply doing a k1 for fiancee, and will plan on bringing her child in the future. I know I can't claim them yet, I was just wondering if I should to appear I would be able to.

What is shown on the 1040 for gross income

Hey Hank, I'm so confused.  I'm reading other threads where they say 'Total Income' is the number the CO looks at. not AGI ? I'm really not sure. So I attached the 1040  numbers I have now so we are looking at the same thing.  I can make adjustments to make AGI raised from 19,711 to 21,600 (125 poverty rate), but will cost me another $500 to pay in taxes.

Can you or anybody please help me with what line I need to be concerned with. I used search here on VJ and you would be surprised at how many conflicting arguments I see on this or older out of date form information .  Is it line 8b or 7a ?

For example for self employed people,  if I quote the boundless website

Quote

What sources of income can I include?

In general, your annual income as a sponsoring spouse is the same figure you reported on your U.S. federal (not state) income tax return for the most recent tax filing year. As of the 2019 tax filing year, this figure is your “Total Income” listed on line 7b of IRS Form 1040. Your total annual income can include wages and salaries, retirement benefits, alimony, child support, dividends or interest earned, and income from other legal sources.

Which would make my example above 1040 correct.

But then as some of you have said, pay attention to the line 8b or 'adjusted gross income', which my example form below falls below.  Done anybody have a definitive answer?  AGI to be safe?  it makes a difference on ones pocket. Sorry just want to make sure as tax deadline is coming up... uhhh tomorrow

Total income.  Just be aware, being $300 above the minimum doesn't guarantee success

Hey again thanks, in your opinion what number would?  That was just an example. My actual is still fluid

My opinion doesn't matter.   The consular will decide based on the totality of the circumstances.   It will probably be ok for Manila.   For AOS?  I don't know.
