hello I have a quick question , can you be a sponsor for two people. right now my wife immigrated and we are waiting on her GC interview but due to covid19 this has been postponed till things get back to normal. now we have a close family friend who immigrated with her husband and has her own process going on...sadly she got an RFE twice about her husband not meeting the requirements because he has not filed taxes because he's been studying medicine abroad. they are no in Puerto Rico and are trying to file for her adjustment and her case has been set back twice because of the affidavit and not meeting. they have a young son and there household equal to 3 but the son and husband are us citizens born. 

 

my question now is , can she use me for an affidavit of support.....while my wife also is using me for her own AOS case? 

 

please help she only has 28 days left to respond and they stated that if she cannot fix this issue or send in the correct paper work that she will have to self deport or she will be given a time frame before they will deport her.  PLEASE HELP WITH AN GIVEN INFORMATION.

Yes, she can have you as a co-sponsor. But be aware that all households will be included. For example, if you and your wife have 2 kids, then you have to make enough of the poverty guideline for  5 people (you, your wife, your 2 kids, and your friend's wife). And if your friend's wife has kid(s) that is immigrating too, those are headcounts also.

 

But another very important thing you should know is that the tax issue HAS to be resolved. If he has not filed taxes, it doesn't matter how many other co-sponsors he has. He needs to file those taxes. And to be honest, that is more important than a cosponsor right now.

They haven't filed taxes because they haven't lived or worked in the United States they have been studying medicine abroad. Met there wife feel in love and have recently had a child in Puerto Rico where they currently live now. There case was returned back first on the basis that he didn't make enough currently and because he hadn't had any taxes filed in which they explained and got another rfe stating they would absolutely need a joint sponsor. 

 

As to my question, because they wife is the only one applying I would be helping with being a sponsor to her or her entire family ? Being that it's onlyy wife and I no kids or anything crazy of sorts..... currently I make around 33'000. Does that hold me down enough to be able to help my friend without hurting my wife's own AOS application because currently we are only waiting on the interview which has been postponed because of covid 19 my friend has about 28 days to respond if not she will get deported..

 

Please please someone help with any information or any work around there are no contact centers open and they will not state anything via the phones

You seem to not be getting it.... it doesn't matter if they are no longer in the US. An American citizen HAVE to file taxes even if they move anywhere in the world. If you are a citizen and were to leave the US and move to another country, you still have to file taxes every year with the US government. We are trying to tell you that even if you cosponsor them, they will still not get approved until the taxes are filed. And I'm not talking about just last year's taxes, but every year they have not filed. For example, if they have not filed taxes since 2015, that means they have to file taxes for 2015, 2016, 2017, and 2018. 2019 may not be needed yet because technically we are still in tax season. 

 

This is very important. You are so worried about being their cosponsor that you re overlooking the bigger problem. Tell them to file their taxes ASAP.

You would  be cosponsoring for anyone that is immigrating. If it is only your friend's wife, then it would only be for her.

Usually, it wouldn't effect your wife's AOS. But that doesn't mean that it definitely won't effect it. I know that seems confusing but all I am saying is that you should be fine, but anything is possible. Nobody on this site or anywhere else can predict what will happen. If you make enough, you can give it a try and see what happens.

 

But if you want my personal opinion, your friend has other issues that need to be taken care of (taxes). I know you want to help, but I would want to take care of my wife's AOS before being legally tied for another petition.

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

My friend's husband (US citizen) never filed taxes in his life. They found a sponsor and their lawyer helped them to write an explanation letter why her husband never filed taxes. She never got RFE and she got her GC without any problem.
