Can he get a SSN for his son if he gets a passport first in the USA and does he forfeits his chances for a CRBA which is basically a USA birth certificate which is needed for alot of things in America. Is it really wise for him to be getting just a passport? Can he access a SSN for his kid this route? Just curious and wondering because I would hate for the kid to not get access to things because of no SSN.

You can get a US passport without a SSN, and you do forifit the CRBA if you get a passport in the US.

Dang what a pickle to be in. He needed that CRBA huh. But im glad he can access a SSN for his kid at least there's that. Thanks for the reply.

There is always the possibility of getting a N-600 instead of the CRBA. @makhan27 you should look into this if you don't do the CRBA.

I will keep this short - me and my family moved to the US. However whilst we was in the UK we did not file the required CRBA at the US embassy. 

 

Fast forward now we are trying to apply for a passport for my son but was told that we needed a temporary i551 stamp that can be done at the USCIS office.

 

Just wanted to know if was possible and if anyone can relate to my experience?

Clarify if it is a US passport you seek.

Does your child need this for emergency travel, because the State Department announced passport services are strictly limited.

  • Your foreign birth certificate listing your parent(s)

well this is the confusing bit - my son entered on a ESTA as we did not know we had to do any paperwork. I thought it would be a straightforward case to apply for a passport.

This is the thing that is baffling me as I have spoke to the post office and the passport helpline and wen I mention the documents listed above they tell me that he needs a i551 stamp and cant apply for a passport till then.

I don’t understand the I-551 (permanent resident stamp) and how it fits in. Is one parent a US citizen? 
If the baby entered on ESTA with a British passport, then how could USCIS give him a greencard (stamp). He didn’t get an Immigrant visa. Maybe you didn’t explain enough? My son entered as a tourist. He can not get an I-551. He is the child of a US citizen which makes him eligible for US citizenship. 
 

Is a US passport absolutely necessary immediately? Might be easier to sort out later.

I’ve tried to explain but they won’t listen - yeah the mother is a US citizen. Well we have moved to the US and wanted our son to get the citizenship straight away. They insist I speak to USCIS whom are closed. We are heading back to the UK on vacation in December.

I *think* the problem here is arising because he entered on an ESTA. Usually when applying for a child in the US born outside of it, the child has either entered on an immigrant visa or adjusted to green card status and some point, and then naturalized (there is a child of citizen route that requires entry on an immigrant visa but I don’t recall the details). So I think the issue is that you didn’t do CRBA/passport application from abroad, and now they are following the normal rules for a child that did not enter as a USC and is now claiming citizenship. I hope USCIS doesn’t make you apply N600 first, which will cost $1170 and take at least a few months, but it’s more likely you just need to get further up the chain at the passport agency to someone who actually understands your issue.
