Applied for AP but got no combo card

Timeline

Hello,

 

I am super excited cause after about 5 months of filing AOS from a B1 vida by marrying a USC I got my EAD today. However I applied with a lawyer for advanced parole and my EAD clearly says not valid for re entry. Could it happen that they just simply don’t give me the AP? What can I do in this case? I really must go home when the covid 10 situation settles.

It sounds like you have only been granted EAD and not an EAD / AP combo. Your card should say (front of card, bottom right) "Serves as I-512 Advance Parole".

I do not know enough about your AOS to know if you leave it would be classed as abandoning your applicatio.

Could be that they haven't processed them at the same time (happens typically when you didn't file concurrently). It just means you'll get a separate AP document when approved.  

 

What is your I-131 case status saying?

I filed through a lawyer and I just noticed that I never really applied for AP when all the while I thought I did. I no longer have a lawyer, we had to give him up cause we moved and he wanted 2000 extra dlls to come to the interview. Anyway I just looked through the copy of my file he sent me and we applied for i485, i785 and i130. No i131 in sight :( I’m bummed. The lawyer did mention it and when he said that there was no fee for the i785 when filing together I thought he meant the travel permit. 
 

I guess I could file right now but I don’t have money to apply plus I’m sure it would take Even more time now with the office closures and everything. I will have to wait for my green card and God knows when will we get the interview.  Well at least now I can work.

If you have filed an I-485, there is no fee for subsequent filing of the I-131......I would file it asap along with the receipt you received for filing the I-485.  Your attorney should have known this, and he/she most certainly should have filed an I-131...........In fact, I would have a serious discussion with him/her.

 

In my book, this is a serious failure of the attorney.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Agreed - the attorney failed to provide adequate service by not mentioning or making it clear that he was not filing for both work authorization and a travel document to return to the US. I can understand if they did not file because he wanted more money for it (the forms are simple but work is work), but he absolutely should have made it clear what was being filed and what that meant, and present the option to file for AP as well.

 

Sadly, it's just another case of where you really need to be involved and educated on the process on your own. Even if you use the services of a professional, it's your case and you always need to be on top of it as it is your neck on the line even if they make a mistake.
