If she added your name and SSN, it's your return as well. So you filed taxes last year. (At least the form is pretty clear when it says to only add the name of the spouse if filing jointly).

His name would be on a Married Filing separately return as well.

Instructions for 1040 say:

Married Filing Separately
Check the “Married filing separately” box at the top of Form 1040 or 1040-SR if you are married and file a separate return. Enter your spouse’s name in the entry space below the filing status checkboxes. Be sure to enter your spouse’s SSN or ITIN in the space for spouse’s SSN on Form 1040 or 1040-SR. If your spouse doesn’t have and isn’t required to have an SSN or ITIN, enter “NRA”.

He already said  he didn’t file and his wife made too much money. The credit will be a new line added to the 2020 return people will file next year. If you got a payment early, your 2020 return will say $0 credit. If you didn’t get the early payout, then you may qualify on the 2020 return. For example, if this bloke files jointly next year and their combined income is less than $150,000 AND neither got an early payment this year, then the extra credit will be applied on that tax return in addition to any refund they might be getting.

I missed this part in the instructions, since the form itself says "if joint return" before the spouse's name.

By his posts, it still seemed like he didn't know if she filed jointly or separately, that's why I told him to ask her (I would assume they filed jointly because of the standard deduction o 24k). And she might have made more than 99k last year and less than 150k, so they would be eligible.

Anyway, it's impossible to say now without him looking at their 1040.

filed 2019 tax return joint married

Assuming you listed her SSN and not an ITIN on the tax return, the advance rebate will be for 2 adults ($1200 * 2).

The other factors you noted have no impact on eligibility for the return. Just the tax return being filed jointly means she was considered a US resident alien for tax purposes, which is sufficient.

  • 3 weeks later...

I just got a notice from H&R Block today saying to check the Get My Payment website. When I did, it immediately said I'm eligible after weeks of saying there wasn't sufficient information to determine my eligibility. So long as you have an SSN, filed for 2019, and are a US resident alien for tax purposes, you'll get a check (eventually). Keep checking back once or twice a week to see if something changes.
