I don’t see why all the fuss on income and taxes at this stage.. the info’s not going to be needed for at least 12 months. Unless of course your planning on her doing AOS after getting married in the US which would constitute fraud without a K1 visa.

 

You don’t need to be in the US to marry.. you’re both currently together in the UK, marry there and submit i130, problem solved for now..

its dosent matter where you marry provided the marriage is legal in the country it occurred then its recognised for spousal visa... 

 

no no idea what you mean by effect “the spousal visa process in the UK”, the UK has nothing to do with US immigration

The issue is you cannot just get married in the UK  w/o a proper visa.

The US absolutely recognizes UK marriages. No issue there. The issue is actually getting married.

Important to use the correct terms for your context.  For the affidavit of support that's going to come sometime in 2021, not now, it's the "TOTAL INCOME" number on the first page of your latest1040 form that is your "current income".  For the self employed total income equates to taxable income, not after tax income.

The anonymous quote in my timeline is applicable here.  We Americans tend to be pretty naive about how things work in other countries.  We also have to learn uncomfortable facts about how people from many countries, really most of the people of the world are not free to come and go from other countries like we are without visas.

And....Since visas are issued outside the country they are for entry into, the US Citizen stuck IN the UK, can't get one.  Catch 22.

Hello, 

 

A lot has changed since last time I wrote! We don't know how the process is looking after Covid, however assuming everything still remains the same we have some questions: 

 

1) My gross income for 2019 was 70k, as I'm self employed I have a low after tax income and in the previous 2 years it's been around 12-14k. I was wondering with regards to the spouse visa application, is it better to alter my taxable income to 28k and therefore to have sufficient earnings for this process? 

Alternatively, I have the option to go for joint sponsorship. as my parents have agreed to that, so really I was wondering what is the better option? To keep my taxes as they are currently low and go for joint sponsorship, or adjust to 28k? 

 

My next question is related to the current situation on restrictions to travel. We were planning to get married in Colorado this weekend, however we travelled to the UK in Feb and are now stuck in the UK, as my partner cannot fly to USA currently. We've done a lot of investigation, and it is not advisable to marry in the UK as it will effect the spousal visa process in the UK and we cannot fly anywhere else right now! And if I leave, we don't know when we will see each other again, so my next question: 

 

2) We found a website online to get married, eg. www.webwedmobile.com, and was wondering if this is viable to start the process? If this is not recognised by the law then I guess we will have to wait to see what happens after travel restrictions are lifted.

Just to be curious... Since you're not married yet, why not file the K1 while y'all are on lockdown in the UK and then marry in the US and AOS?

Is there a specific reason why you want to go the spousal way (e.g. immediate ability for her to work in the US and travel, which is not given going the K1 way)?
