I-751 with RFE, want to separate

Hi, 

 

I have filed I-751 in January 2019 and I just received RFE couple weeks ago. I have no idea what options I have at this moment

 

We didn’t have a strong evidence (even though my AOS was approved on the spot) when we submitted I-751 because of certain situations which was explained when I filed it. My usc wife has horrendous credit (we are talking about in the 400s) and few criminal charges (couple misdemeanor theft) make it almost impossible to put both our names anywhere. She couldn’t get a car financed so my car is only under my name. She won’t be able to get an apartment lease because she has horrible credit on top of criminal history. She can’t be on my car insurance because she wrecked a couple cars in the past (insurance literally quadruples if I add her as a driver)

 

I have submitted

-3 affidavits proving bona fide marriage

-a lot of pics

-life insurance, her being the beneficiary

-couple utility bills together

-joint tax returns, bank accounts and driver license with same address

 

i just can’t find a way to strengthen the case. She has been using a separate bank account but still uses our joint account (she gets her paycheck deposited elsewhere). I thought it was odd but in the end, I discovered she was cheating on me and on top of that she uses my immigration status as a leverage and I just have to understand what’s going on.

 

We still live together because I can’t really afford thousands of dollars on immigration lawyer trying to submit a waiver but at the same time I am under great amount of stress just being around her. I genuinely entered this marriage 4 years ago and so did she but now she just treats me like ####### despite me being nice to her. 
 

I just want to get out of this marriage but I can also stick out till my I-751 result comes out. I just don’t know if it’s worth it to stay with her considering my case sounds weak with lack of evidence.

 

What options do I have? I’d love to get out of this marriage and start my life but at the same time I would definitely not like to be deported when I didn’t do anything wrong but being nice and genuine to my us citizen wife while trying to keep this marriage alive when she was the one who wrecked it.

I would not "stick out till your I-751 results come out". It actually might look more suspicious to USCIS if you get the conditions removed and then immediately file for divorce. It might cause problems for your citizenship process.

 

I actually have kept it a secret but my husband and I have also separated and I have filed for divorce. The virus is definitely not helping but there isn't much that I can do. Hang in there and keep your head up. I would file for divorce ASAP but then again, I do not know how possible that is because of COVID-19.

1/10/2020 (Day 126) - Received Biometrics Letter
1/23/2020 (Day 139) - Biometrics Completed

2/8/2020  - Separated from Husband

8/11/2020 - Divorce was Finalized

9/10/2020 - New Card is Being Produced

9/14/2020 - New Card was Mailed

9/15/2020 - Post Office Picked Up the Card

9/16/2020 - Card Delivered

8/21/2022 - N-400 Form was Submitted and Case is Being Actively Reviewed

10/21/2022 - Interview scheduled

12/1/2022 - Interview and approved

12/1/2022 - Oath Ceremony Will Be Scheduled (30-45 days)
