Weird situation.

 

Currently applying for IR1 visa. Received NOA2.

 

Had an offer from employer. Employer asks is it possible to bring me over on work visa.

 

Am I able to go to the States on a work visa, AND apply for IR1 at the same time?

 

Asking my lawyer but wondered if anyone had thoughts on this. Thanks!

You could, but if the work visa was approved prior to ir1 and you entered the us, then you’d need to switch from ir1 to AOS as the ir1 is only issued to those residing outside of the us. 

 

When did the offer of employment happen? It might be hard for an employer to demonstrate no US skilled workforce currently available for the position given the current economic downturn

Suggest you esquire about the timeline for the work visa, which one is it?

Gotchya. I'd much rather the Ir1 visa. I don't want to be tied to the job.

Well under normal circumstance E3 and adjust would have  a lot going for it. currently no interviews.

E3 can be obtained relative quickly so move and then adjust whilst you ar here and how long it takes does not really matter.

 

However Consulates are not undertaking interviews and if they were unless you are married to a USC you can not currently enter on an E3. Now when they will be interviewing E3's well who knows, in the meantime the IR1 is proceeding.

Not to my knowledge, so say you apply for both E3, being quicker is to less advantage as the IR1 is still processing and catching up.

No. Routine visa services are closed worldwide.
