Well it says that a notice was returned to the Uscis because it couldn’t be delivered, which was just the first paper NOA1 and changed just a couple weeks after online notification that our case was received. We have since received the NOAs for all 3 applications in the mail, but the case status online still says notice returned to Uscis as of May 29th. The EAD says “duplicate notice mailed.” It’s even more frustrating just seeing that!

I'm in the same boat (ASC is Louisville, KY), filed same date as you. Last time I spoke to USCIS they said all I can do is wait and to not expect anything up to at least 30-60 days from opening (July 27th). I understand your frustration, especially with seeing so many people receiving biometric appointments and having cards approved! Hopefully you can find out some more info through the tier 2 rep!

This is so awesome! I'm in Arizona, and they would not let me sit my drivers licence test, despite having all those documents you mentioned. I think the issue with me is that my passport and expired I-94 are in my maiden name and my I-797 notice, my SSN and proof of address are in my married name so they couldn't verify my identity or something? What is the REAL Act? I wonder if that could help my case.

I totally agree, after waiting for 50 minutes to talk to someone, they told me that they couldn't transfer any calls to a Tier 2 Officer anymore.

All I got was that the processing time is 28.5-38 months and that I would have to wait since my case hasn't moved since June.

Really frustrating but I guess I'll have to wait this long now.

Page 3, item ix. It's under this basis a I-485 I797 can be used to confirm lawful status (along with valid Passport, I-94 print off from CBP website, SSN and 2 proofs of home address). Insist on them processing your application (whatever the state it is that you reside). When they input either your I-94 number, passport number or SSN, a SAVE Trace is done (a direct link that goes to USCIS to check your legal status). It normally approves or disapproves in seconds - wish it could all be that simple but that shows you how technology work.... They didn't really look at my I-797 either, just entered my details and the system said whether or not I was eligible for a DL.

 

It's all there in black and white and we are all eligible with the docs mentioned above - its just the person on the other side of the counter you need to convince.

 

I would also imagine a marriage certificate proves a name change but can't be sure.

I may be reading this wrong but I understood this document as saying these are the minimum requirements a state MUST require, but they can add on additional ones. I passed it to my husband as he's a lawyer and much better at reading these types of documents than me 😬  I still think it's worth a try either way though! We may go into the DMV next week and see what we can do.

Arizona doesn't mention I-797 anywhere on their website. It may be they don't accept them but it's worth a try. Good luck!

Thank you for sending this through. I even brought in my marriage licence to the DMV, but there was still nothing they could do (so they say). I think I will just wait to get my EAD and take that in, hopefully that will work. 

I had my biometrics today and my status has updated to card being produced, so I'm pretty stoked!
