Checking my account and my phone again and again in hope of a positive update-

Hello! You can reuse all of your supporting documents and any forms that haven't expired. However, you will need to use the new I-485. You can check the date on the bottom left corner which should be dated 10/15/19. That is also the same date as the new I-864 (affidavit of support form) so you may need to do a new one of those as well if it does not have that date. Also double check your form I-765 (Employment authorization form) and make sure it's dated as 12/26/19 because starting today (4/20/2020) they will only accept that form.

Don't forget to also submit the form I-944 plus its supporting documents.

Hello again, I hope everyone is doing well!

 

I have a question regarding tax return (for I-864 Affidavit of Support). My husband has not filed for the most recent tax year (2019). Well, it is actually still in progress and he expects it to finish next month. He worked abroad last year and that's probably why it's taking longer and more complicated. However, since the deadline for filing tax is extended to July 2020, do we put his 2018 tax as the most recent, or should we disclose that he has NOT filed the most recent tax year?

 

Also, will this become a problem for my AOS process if we don't include the 2019 tax during initial filing?

Hi everyone! These forums have literally been my life saver for the past 3 weeks, and I would love a bit of support on the following. We originally filed for K-1 visa on the 11th Feb, and I was meant to be returning to the UK on the 29th April. However due to COVID19 - we decided to go and get married, and have been basically doing paperwork ever since! As i'm sure you all understand.

 

Anyway, we are ready to send our pack off (i-130, i-485, i-864, i-765, i-131, i-944). Im just waiting on the equivalency of education report to come which might not get here until April 27th, and a letter from the bank showing our joint account. My ESTA runs out on the 29th April, and i received an email from US Border Control reminding me to leave by then, this has obviously made me nervous.

 

Shall I just file everything and send my missing documents at a later date, I can put in my receipt from the International Evaluations Company? Or hold off until I have everything. 

 

Hoping you can calm my nerves! And I can get this pack on its way in April!

Overstaying doesn't usually count as a negative once you are married to the United States citizen. The only thing that matter is that you entered the country legally. Also I would wait until I have everything then file, AN RFE is just going to further delay your case. Also the forms ask for current immigration status so if your ETSA is expired by the time you file be sure to update your status.

It is indeed a lot of paperwork to go through- great job in getting through it all. 

 

here are my thoughts  - I would file -

Malajoe is indeed correct when stating that an overstay will normally not count as a negative  in terms of your AOS case. ( it is forgiven if not exeding 180 days)

HOWEVER - you DO run the risk of entering into removal proceedings - and you could be unlucky to come across law enforcement - see this story - 

 

 

Chances are probably slim - but do your own risk assessment -

 

I Would send a printout of my bank account and not wait for the bank document and write a statement that the originals will be available if and when required.  

I would also see if you could get a PDF copy of your transcripts and the report E Mailed to you- and write a statement explaining the cause for delay and that the originals will be available if and when required. 

 

I did that myself, hoping to get a reply any day now- i will advise as soon as i receive the responce from USCIS .

Good heavens you April  2020 filers have been going through sheer terror with this I-944, IMO seems the form is doing what it was designed to do, but I won't go there. I applaud each and everyone of you for your tenacity and persistence. Don't  give up if you fall on your bottom get back up and submit it again.

I'm  very sorry I could not be of more help dealing with the I-944 since I applied  well before the first deadline.

Just another example of the fine paperwork that comes out of opps said I was not going there.

Look at it this way in a hundred  years who will care lol. Great job April filers. Once all your packets are in the pipeline you'll all be valuable assets to VJ insofar as the filing of the dreaded I-944.

Citizenship Complete!

I just read the news too. I am worried as well. I am not sure what this means to people doing AOS through K1 but we will have to wait until he actually signs.

lets try and remain calm in the manner - I freaked out too - so mainly trying to talk myself down into a calm situation - i really hope i receive that NOA1 tonight....

please keep eyes and ears open and share any information that you may have come across with us all here ...

 

FINGERS CROSSED .... 

 

( the policy implementing the I944 form was signed around spring-summer last year but cam into effect only recently -   I know this is Different, and my gut feeling is it pertains to Visa issuing and hopefully not Current  AOS Applicants)
