I was almost in your exact same shoes.  Husband came over on an ESTA and then corona happened, so we decided to do AOS.  UPS said our package was delivered on 4/7.  His ESTA expired on 4/8.  We didn't hear from USCIS until 4/30, so we were VERY nervous for those 3.5 weeks.  My anxiety had me worried ICE would show up at our front door 😂. I was so relieved when we finally heard back. The NOA said that our petition was indeed received on 4/7 (just took them 3.5 weeks for them to notify us!), so I don't think he actually accumulated any overstay since it says right on the receipt notice that they received the AOS one day before his ESTA expired😅.  Anyway--long story short--if yours is like ours, I think you should be fine.

USCIS works just like any other office/ business. The letter arrives, gets an received stamp with the days date and then waits on a pile to to be looked at. So the NOA1 date is usually the received date even though nobody looks at it for three weeks. They at least don't punish you for not having enough manpower. And even if it's received after the admitted time on the visa, the spouse of a USC won't accumulate unlawful presence. Overstay yes but that is forgiven as a spouse of a USC ( not sure about LPRs ). 

And while that time might be stressful it's highly doubtful that somebody will knock on your door. Best bet is to stay put and don't get involved with the police 😊

This has just come up to me and I hope someone has an answer. Thanks

So, I already have an EAD and SSN through my F-1 OPT. But when we filled out our I-130/I-485 applications including the I-765 form, I checked the box that requests a new SSC, even though I have one. The reason is that I just assumed the SSC would be different. 

Will it affect my application or affect the processing duration at all?

No, it will not. When it comes to SSA, they will quickly discover that you already have a SSN and won’t issue a new one but it will not affect your Work Authorization application .

We are still trying to make sense of the separate I944 for a K2 minor child issue.  We were nearing completion of our AOS packet and now this new stumbling block...

 

I have read the posts here that indicate RFEs are being issued and that a separate I944 is needed for K2 minor children. 

 

My question is....are people simply sending a copy of the K1s I944?  If so, how is this correct?  Shouldn't the K2s I944 be filled out differently than the K1s?  Seems to me that simply photocopying the K1s I944 is not correct if USCIS is requesting an I944 for the K2...some of the evidence would be the same...but the form itself has to be different right?

 

Your thoughts please...

Hahahaha I wish that was true. Wouldn't have two SSNs by now. Waiting for the SSA to open again so that I can return the second one.

 

But no @ethngd it won't have an effect on your application or the processing time.

For real? Lol. Well, I actually filled out my SSN in the form so I probably won't get a new SSN. Perhaps a new card (!?) But as long as it doesn't affect the application, it's all good.

My credit card was charged on Thursday by the Chicago Lockbox, but I still haven't received a text or email with case number or where it's being sent to. Is it worth calling trying to get a case number & our NOA1? We need that to apply for the I-131 (we didn't learn about this until after we submitted the AOS).

Yeah you can go ahead and ask Emma. Myself and some other people here got the numbers the same way. Talk to a rep and give them personal info and you should have the numbers.

call USCIS and ask - i got the text 4 days after payment processing - the hardcopy about a week later.
