Hi all, 

 

We are beginning to put together our AOS package and have a question regarding what must be submitted with the Advanced Parole I-131 form. 

On the checklist of required initial evidence it asks:     

  • If you are an applicant for adjustment of status, a copy of a USCIS receipt as evidence that you filed the adjustment application

Can someone confirm exactly what this is?

@AlanaM and @malajoe did your rejection letter specifically state that the rejection was for an incomplete I-944? Just curious because mine have both been so general, referring the whole thing being incomplete and listing all three forms, that I am just assuming it was 944 related.  If you got something specific, maybe that means mine was NOT 944 related?

When your birth certificate is not available or does not exist, you must submit other acceptable evidence relating to the facts of your birth, such as church or school records, hospital or medical records, personal affidavits, or similar evidence.

This refers to those who apply for AOS and AP separately. If you were to apply for AP after applying for AOS you would need to submit a copy of NOA1 for AOS as evidence that you applied for AOS. Since you are applying for AOS and AP at the same time, you don’t need this.

So for I-131 if you are submitting the entire package(I-130, I-485 etc etc) together you dont have to provide anything regarding that particular question as far as I know. I only provided the proof of my current visa status and the passport biographic page with two pictures of me with A-number on the back.

Dang it. Missed your date of filing. Basically when went over the last time for all the packets my wife found a bunch of issues with 5 year address history and then began the searching for all the dates. Lol. I ended up completing the package late Saturday so will be sending in tomorrow first thing in the morning. Will be two days behind you. It will be interesting data point on here to see how big of a difference that makes in getting overall process. haha.

If you’re submitting I131 separately you need to include the receipt (NOA) of I485. If you’re submitting at the same time then it doesn’t apply.

All, Just a heads up of a small date discrepancy that I noticed today while checking all the forms before shipping them off. The form I-485, I-864 and I-944 were effectively revised to reflect the the Feb 24 ruling and the expiry of all three forms is 10/31/2021 and edition is 10/15/2019. Atleast thats what I downloaded and am going to ship. But as of today the USCIS website shows the expiry of form I-485 to be 10/31/2020 but the edition is the same. Dont know if I am the only one with this issue or something changed. For now everything is sealed for me so I am going to just go ahead and submit the documentation but just want to bring it to everybody attention. Let me know if you see the same issue. Thanks.
