Hello. About to file for marriage based AOS for my wife next week but have a question. I became a USC a 12 years ago and now I130 is asking for my certificate of naturalization number, which I don’t have after moving (it’s in storage in a different state, not the best time to go get it... if it’s even still there). And the FOIA request for a copy has not moved up in queue at all due to COVID19.

Does anyone know if I can leave that blank and can use an addendum to explain why I don’t have my certificate of naturalization number? I don’t think we have  much time to wait for FOIA request because her visa ends in June.

Much thanks!

Yes its the same fee. I had the same thing happen to me. I got my package returned April 11th and sent it back in today. It was because my I 944 was incomplete.

I think if you leave it blank the form will be considered incomplete. Have you tried calling USCIS to request that information?

Did a little digging for you and there is a form N 565 but that thing costs $555.  N-565, Application for Replacement Naturalization/Citizenship Document

Thanks for that. I had seen that before but not sure if it applies to me.

It's not a required document, so I used FOIA to request that information instead of the N565 to get a replacement. This is an option via USCIS's FOIA portal.

I'm just wondering if an addendum is something that can be done - and if my explanation would suffice for now, and they can request for more evidence later, at which point I hope the pandemic would be less severe so I can travel.

I haven't been able to get a clear answer from USCIS; its automatic answering system does not route me to a person who can help me at this time.

I'll try again next week.

Just to add: I'm hoping to use Section 9 on I130 for additional info, then refer to an extra addendum that I'll include as explanation of why it's not feasible to get my Certificate of Naturalization number at this time (potentially lost, and USCIS is not processing FOIA requests during pandemic).

Hi guys, i'm new here. Is there any alteration for the birth certificate? Is it a must? Can you submit different forms of documents similar to it. If so, do you have to request for approval? Anyone who had the same situation like this before?

Form I485 Instructions: Page 9

If you are unable to submit the required primary evidence (for example, a birth certificate or marriage certificate), you may provide secondary evidence (for example, church or school records) instead if you can explain why the primary evidence is unavailable. If you are unable to submit secondary evidence, you may submit two or more affidavits, sworn to or affirmed by individuals who are not parties to the immigration benefit sought and who have direct personal knowledge of the event and circumstances. You must also explain why primary and secondary evidence are unavailable.

If your birth certificate is unavailable or does not exist, you must prove its unavailability or nonexistence and provide acceptable alternative evidence of birth. (Refugees and asylees do not need to prove unavailability or nonexistence of their birth certificate.) You can look up your country of birth on the following website, https://travel.state.gov/ content/travel/en/us-visas/Visa-Reciprocity-and-Civil-Documents-by-Country.html, to see if birth certificates are known to be unavailable or nonexistent in that country. If this resource shows that birth certificates from your country of birth are generally unavailable or nonexistent, you do not need to do anything to prove that your birth certificate is unavailable or nonexistent. If this resource does not show that birth certificates from your country of birth are generally unavailable or nonexistent, you must submit an original document from the relevant governmental authority explaining why your birth record does not exist and indicate whether similar records for the time and place are available. When your birth certificate is not available or does not exist, you must submit other acceptable evidence relating to the facts of your birth, such as church or school records, hospital or medical records, personal affidavits, or similar evidence.

3.5 lbs AOS package mailed to Chicago via 2-day UPS on Wednesday April 22, delivered and signed for on Friday April 24 by Chyba.

I-944 was the thickest part of the packet, followed by proof of bonafide marriage.

Also I submitted a lot of redundant copies with each form of my packet for supporting evidence. Each form is self contained with its own evidence. For example multiple copies of marriage certificate, birth certificates, passport biography pages, I-94's, IRS Tax Return Transcripts, etc.

All forms submitted:

  • G-1145
  • I-485
  • I-130 / I-130A
  • I-864
  • I-944
  • I-765
  • I-131
  • I-695 in sealed envelope

Me and my wife might be moving to a new residence, not sure is this will be an issue this early in the process with USCIS, assuming I do correctly inform them of the change of address.

Amazing work. Well done!

Which visa type are you adjusting status from?

My packet was received Thursday 23rd, so we have very similar timelines.

Good luck!
