Others on here have had their application returned to them if missing I944. 

 

I would start with reading the instructions that comes with the form to know what you need. It is not a question I can answer for you. There are many things you need. I would look at other posts on this forum for more specific guidance on what you need.

We didn't check anything since she is on my insurance,

we made ours look as nice and easy to read as possible, i figured if they grab one, they'll grab the easy one lol, but who knows how it actually works.

we sent ours in a small box we purchased from ups, about the size of a binder, not big.  we put our 131 and 765 in a folder, one on each side pocket of the folder with a sticky note saying 131/765. the evidence required for each were behind each of those forms.

then we got an envelope folder (with Table of context) listed on the front.  We placed all the forms and evidence as we listed in the Table of context and used a paperclip to separate each section.

My case is a bit weird. I used the old form  i-495 but I did include the i-944 even though the old form doesn't mention it. I read on Visa Journey last minute before mailing mine that we need i-944 so I included it. They still rejected mine and my entire packet was returned in 10 days. On the USCIS website it said that they would reject packets with an outdated form. I had to refile everything; however, I found out about this 2 days after I mailed it and started working on the new forms immediately after that so I was able to mail everything back immediately after I got mine back. I would start filling and allocating evidence for the form i-944 now.

Hi all, 

I have a few questions regarding the AOS package, any advice would be great.

 

  1. Is at necessary to submit continued proof of evidence of relationship? I have seen some people saying they have submitted additional photos etc. Surely our marriage certificate should be enough proof?
  2. Should my wife change her bank account to a joint account? (I am the beneficiary). I have already been added to her insurance and I have enough savings to help demonstrate that I won't be inadmissible based on the public charge ground

You definitely want to show as much proof of Bonafide relationship as you can. In theory marriage certificate is enough, but not in practice.

 

Merging your finances is one of the most important factor used to prove a bonafide relationship, taxes, bank accounts, credit cards, retirement account beneficiary, anything else related to finances.

I also got rejected for incomplete i 944. Should be resending today or tomorrow.

If you already have insurance you are not required to complete 15D. If you answer no then you proceed to 15D

you want to overwhelmed them with proof to be honest. A financial relationship is huge (joint accts, life insurance, joint medical/dental)

A lawyer also advised me to do the i 864ez instead of the regular i 864. The ez shows that you make enought money and not needing a joint sponsor. There are three requirements that must be met to file the i 864ez.

You may use Form I-864EZ if ALL the following conditions apply:

1. You are the person who filed or is filing Form I-130, Petition for Alien Relative, for a relative being sponsored;

2. The relative you are sponsoring is the only person listed on Form I-130; and

3. The income you are using to qualify is based entirely on your salary or pension and is shown on one or more Internal

Revenue Service (IRS) Form W-2s provided by your employers or former employers.

I only submitted my marriage certificate. Can you direct to where in the instructions it asks for anything more? 

 

Our I129F had so much proof and they still have all that. I filed my AOS only 3 months after getting my I129F approved, so for this reason I feel marriage certificate should be enough. Unless I overlooked where they asked for more than that?
