can I apply for my spouse to get health ins on the open market place while AOS or do you need a green card first?

The AOS applicant may also get Affordable Care Act subsidies: https://www.healthcare.gov/immigrants/immigration-status/

Applicants for any of these statuses qualify to use the Marketplace:

  • Temporary Protected Status with Employment Authorization
  • Special Immigrant Juvenile Status
  • Victim of Trafficking Visa
  • Adjustment to LPR Status
  • Asylum (see note below)
  • Withholding of Deportation, or Withholding of Removal, under the immigration laws or under the Convention against Torture (CAT) (see note below)

I called them 1/3/20 and was given a biometrics date via email, attended bio 1/5 my case was updated same day to say fingerprints applied. Today got an email saying they’re scheduling my GC interview and will mail me a notice. EAD still pending... fingers crossed they skip EAD and go straight t GC interview

I wonder if you contacting your congressman had anything to do with going straight to the GC interview? Did they said they had already scheduled you or did your case update to “ready to be scheduled?”

Anyone still waiting on an EAD more than a couple months after biometrics? Our PD date is 04/14, biometrics for EAD and AOS on 10/26 (had to talk to tier 2 to get it scheduled in the first place). No biometrics for I-131, yet. Our current case status says "fingerprints applied to case" for both the EAD and AOS, but it has been 228 days since filing and 78 days since bio! I feel like we are the only ones in this boat! Put in second service request and haven't heard anything, but just keep getting told to wait for 30 days for a response.

I dunno, it may be that they realised that I was fully documentary qualified and pending IR1 interview pre-covid when I wound up getting locked down in New Orleans which resulted in my filing AOS.. who knows, I’m just glad things are finally moving forward, we’ve been at this immigration bs since 2018..

For me, the email that USCIS sent me was specifically asking only the offer letter. I sent a very generic cover letter (no complicated format just a small letter), print of the email they sent me asking for the document and the offer letter. If they need anything else, I think the email you will recieve will specify. Have you put in the expedite request already? What category did you file under?

I am in the same (similar) boat don't worry, PD 4/22, biometrics 10/22 and nothing since. Considering filing a request to expedite for the EAD as my current work visa expires in May! Tried a service request but not holding my breath lol
