Hi all, 

 

Can anyone help me, I have a quick question about Part 3, Question 1: Household Income on the I-944 form.

 

For the following question, I am unsure what to put:

 

    Did you or your household member(s), whose income is being included, file a federal tax return?

 

 I am currently in the US as a K1, I married my american wife and we are finishing up our AOS package. 

Does this refer to a US tax return? Obviously my wife will be including her most recent tax return, so should I answer this question yes? and then tick the box that says "Not required to file a tax return" and explain I am not a US citizen. I find the way this has been worded confusing. I will include my most recent UK tax return.

I ticked NO based on advice from others on this forum. Also, It is my understanding that this question is relating to a US federal tax return.

 

I then checked 'Other' and wrote that I filed an Australian tax return for 2019.

Where it says explanation for not filing.. I wrote that I entered the US in March 2020 on a K-1 VISA and intend to apply for AOS and EAD. And that my Australian tax return was attached. 

 

In addition, I wrote a letter explaining it all and also included my last 6 month's of pay stubs (i chose to do this, you dont have to) from my employer in Australia to show that I am capabale of maintaining good employment and that I intend to continue within my profession when my EAD is granted.

You're welcome. 

 

I'm  confident with how I answered that question, but to be honest it's just what made most sense to me, all things considered. 

 

I mailed my packet out yesterday, so will keep you posted with how I go and if I get a rejection for answering anything wrong.

While I am able to get on my husband's health insurance, up until that happened (about a two month process) I was able to qualify for travel insurance from my country (Canada). I explained my situation to the rep on the phone and he said as long as I hadn't reported to the Canadian Govn't that I moved and cancelled my health insurance there, I would be covered. It only cost about $80 CAD a month. Perhaps there is an insurance from your home country you can use that would be the same for now? Maybe it doesn't apply. Just a thought. I'm more thinking about you actually getting stuck with $100k bill then what the I944 requires.

I heard there are some slim exceptions for family/ spouses of American citizens.

We just filed! Just a relief, but also just nervous about the next steps. I will keep you posted on NOA1. Thank you for all the help as well!

Thanks. Looks like it order for people outside the US trying to enter with those exception. 

 

Since my wife is here already. I doesn’t look like it will affect people who are here already.

Sooo those of us applying for AOS are safe because we're married!! I'm so happy I could cry.

I also ticked no and then explained under other. I also attached my German tax return and got it translated.
