Page 3, item ix. It's under this basis a I-485 I797 can be used to confirm lawful status (along with valid Passport, I-94 print off from CBP website, SSN and 2 proofs of home address). Insist on them processing your application (whatever the state it is that you reside). When they input either your I-94 number, passport number or SSN, a SAVE Trace is done (a direct link that goes to USCIS to check your legal status). It normally approves or disapproves in seconds - wish it could all be that simple but that shows you how technology work.... They didn't really look at my I-797 either, just entered my details and the system said whether or not I was eligible for a DL.

 

It's all there in black and white and we are all eligible with the docs mentioned above - its just the person on the other side of the counter you need to convince.

 

I would also imagine a marriage certificate proves a name change but can't be sure.

We are in Arizona and decided to see if we could get an Arizona ID for my husband. We brought his passport with an expired ESTA stamp, NOA for I-485, his ITIN, several letters showing his name and our address in Tucson, taxes for 2018 and 2019 filed together and a printout of DHS instructions from the link provided above. The MVD lady went to consult with her supervisor and returned to say “Sorry, we need his Work Authorization document, SSN or green card”.

Oh well..At least we tried.

I am in Arizona too. And even with my SSN they could not process me for a drivers licence or Arizona ID. I've decided to wait until I get my work authorization to try again. Must be an Arizona thing 🤷‍♀️

I’m in Seattle. Applied for AOS, PD date April 14th, and still no biometrics scheduled. I’ve talked to a few others here, one with a PD date of March 25th had biometrics already, but others in April have received nothing. I’ve heard it’s on of the slower offices. Very frustrating. I assume you are still waiting?

Yes I am waiting. I have applied in August and hence it is really early for me to get an appointment. Especially if April filers still don’t get one :( 

 

I feel like New York and Bay Area is the worst but I do hope after elections things will be smoother with less and less naturalization ceremonies!

Yes, my family-based application was received April 7 and my NOA is dated April 17. I eventually got a biometrics notice for I-485/I-765 dated August 11 which came in the mail August 18, for an appointment on August 26.

 

It's probably just a coincidence but on the morning of the 11th I used Emma to ask if biometrics had been scheduled yet and the answer was no. My work authorization is expiring so I tried to ask if there was a way to push it along and they said no again.

 

It was fairly busy (considering COVID) when I went in with about 5 other people waiting to have biometrics taken around the same time.

 

Later that day the egov.uscis.gov tracker updated to show "Case Was Updated To Show Fingerprints Were Taken" on my I-485/I-765/I-131 cases even though I-131 wasn't checked on the form they printed at the ASC.

We're still waiting for a biometrics appointment at the Salt Lake City office. Got our NOA on April 16 and USCIS received our RFIE response on May 27. I read somewhere else that the SLC office had to reschedule 6900 appointments before making new ones and that they were only scheduling 40 a day. Anyone else here in SLC that could confirm this?
